View Full Version : $77.50 Raffle Spots for Beautiful One of a Kind Ginacue!!!

I am sad to say I have chosen to end this raffle. I was excited, as I know were all the participants, to see this beautiful cue end up in someone's hands for $77.50

I thought it would fill quickly, and certainly started like a "house on fire" but it appears to have slowed to a crawl. Perhaps there aren't 100 people who want to throw $77.50 at a 1:100 chance to win this cue.

My attorney, who I mentioned this raffle to in passing has been "all over" me about it as well. Here is a small excerpt from his last email to me regarding the "grayness" of the law in California regarding these raffles. I pay him handsomely for his advice, and probably shouldn't ignore it:

Penal Code Sec.319.

A lottery is any scheme for the disposal or distribution of property by chance, among persons who have paid or promised to pay any valuable consideration for the chance of obtaining such property or a portion of it, or for any share or any interest in such property, upon any agreement, understanding, or expectation that it is to be distributed or disposed of by lot or chance, whether called a lottery, raffle, or gift enterprise, or by whatever name the same may be known.

Penal Code Sec. 320.

Every person who contrives, prepares, sets up, proposes, or draws any lottery, is guilty of a misdemeanor.

So, given these factors I have chosen to end the auction. All monies received by me so
far have been via PayPal, and I will refund them all immediately (DONE).

I know some, including myself, had an emotional investment in this, and I apologize to any who feel slighted.

I just spent that much to fill my Honda gas tank and would be overjoyed to own this cue. I'm in. I really hope there's enough interest to sell the tickets out.

I've seen this cue and hit balls with it and it is an ivory monster one-of-one Ginacue. I have a new Gina coming (this week!) and would love adding Joe's to my budding Gina collection.

Wow. I haven't been watching all the raffles. When I first saw the post I didn't think the deal would fill up enough to happen but it sure seems like it could now. Once it gets to 70, the existing subscribers would for sure buy up the rest of the chances.

Only giving 48 hours for people to make payment is a little hasty IMO. Some people don't have paypal and will have to mail a money order or whatever. I think postmarked within 5 to 7 days is more appropriate.

Other than that, all is good.

alot of guys cant afford a high end cue like this or the southwest that is goin now, this is a great deal for some and yes its a gamble but most blow money on alot of crap and have no chance at anything like this!!! its a great idea no matter what the seller gets as long as the odds are reasonable for all ! IMHO

I will happily bear the cost of shipping and insurance BUT since many countries have an issue with ivory "clearing customs", I will only be able to provide proof that I shipped it insured. I can't guarantee it will get through customs. If you are willing to assume those risks, I will use whatever reasonable method you choose.

Joe agrees with you. He doesn't like "worrying" about his cue when playing, that's why he's selling it and Ernie is just about done with Joe's new, plainer, Ginacue. Joe feels this cue is for a collector and he doesn't see himself as one, however, at these prices, I would totally play with this monster (and will when I win this raffle).

I play GREAT (for me) with Joe's cue. It inspired me to order my new Gina (almost done also).

I am not REQUIRING payment until 48 hours after the raffle fills, but some people are choosing to pay early, for a variety of reasons.

I "prefer" paypal because the record keeping is clear and if for any reason the raffle doesn't produce a winner, I can refund out of paypal with no fees to either party.

That being said, you may pay however you choose and whenever you choose, as long as it is received no later than 48 hours after the auction fills.

If he runs it like I did my JMW raffle on jimboarmy.com, you wait until everyone is paid before selecting the raffle date. Non-payers can be replaced by stand-by's after a "reasonable" amount of time to pay.

My intent is to have the raffle take place 48 hours after all spots are filled. I stated that in the 48 hours following the raffle spots filling I will attempt to get a few alternates who can buy any unpaid spots after the 48 hours period.

My hope is that all spots will be paid in that time frame and in fact, quite a few have chosen to pay already as you can see in the list in post #1.

I will make a clear announcement in post #1 of the status of payments, and of course I will announce the actual date of the "draw" as well.

I know all participants are anxious, as am I, so I have and will continue to do all I can to speed us to a conclusion with a winner....

Actually, 33 remained. As for the NEW Gina it should be done early next week....I saw it today and it is, to me, the prettiest "plain jane" ever!

You didn't receive the full $77.50 from everyone because Paypal took their part. Yet you had to refund the full $77.50. This raffle is going to end up costing you a few bucks. That's a shame.

If he uses PayPal's refund feature (which I'm sure he will), PayPal credits the buyer back the full payment amount and credits the seller back the fees (only deducting the seller's net from the seller's account) so it's a wash for both, no problem.

Its a shame the auction ended. I think eventually the spots would have filled up. 77.50 for that cue is one helluva deal.

As far as the law, I wouldnt worry about it. If I was in your shoes I'd do it since the cue market is so bad. I'm sure there is alot of cuemakers that fail to report 10K and up cash payments to the IRS as well (as I found out about this the hard way buying a car).

I say if you ban these auctions on here you'll never see another top dollar cue sell on here because nobody will get what they want for it (which is not fair to them).
