First Off I Would Like To Start Off And Say That I Will Not Mention The Other Party Involved In This Dispute. They Know Who They Are. So Here We Go.

I Sent A Pm To A Well Known Cue Dealer Here On Az With A Trade Proposal. I Get A Response Saying That He Cant Do A Straight Up Trade But If I Throw In A Little Cash ($100) We Can Make A Deal. I Respond The Next Day And Agree To His Terms. I Will Ship Out My Cue First So That It Can Be Inspected And Once He Is Satisfied He Will Ship Out The Cue I Am Supposed To Receive.

Thursday 12/13/07 Im On My Way To The Post Office To Ship Out The Cue. I Get A Call From The Person Im Trading With Telling Me That He Looked Over The Pictures Of The Cue Here On Az And That He Doesnt Want To Do The Deal. His Problem Was That One Of The Tips Would Need To Be Replaced And That The Deal Isnt Fair. So In Order To Just Get The Deal Done I Agree To Throw In An Extra $25 To Cover This Expense. I Ship Out The Cue In A Hard 1x2 Case.

Friday 12/14/07 Person Im Trading With Receives My Cue. He Inspects The Cue And The Cue Is Straight Together And Apart Overall In Great Condition But There Is Some Minor Chipping Around The Butt Cap. Once Again He Wants To Void The Deal But Asks Me About The Nice 1x2 Case I Shipped My Cue In. I Assume That He Is Inquiring On Whether Or Not Im Willing To Include The Case In The Deal. So I Tell Him If He Likes The Case He Can Keep It As Long As We Can Go Ahead With The Deal. He Agrees And Ships Out The Cue I Am To Receive. Cue Is Due To Be Delivered On Saturday 12/15/07 Express Mail.

Saturday 12/15/07 I Receive A Phone Call At 11am From The Person I Am Trading With Telling Me That He Wants His Cue Back Because He Noticed That The Cue I Sent Is 59 Inches Long. Since He Is Renegging On Our Agreed Upon Deal He Offers To Cover My Return Shipping Charges.

So If Your In My Shoes What Do You Do????? He Alters The Deal Twice In His Favor And I Accept His Terms Just To Get A Deal Done. Now He Wants The Cue Back All Together.

I Have Done Numerous Deals Here On Az And All The People I Have Dealt With Will Probably Say That My Word Is Gold. But Here We Have I Guess If You Want To Say A Power Seller Here On Az And If He Wanted To Make False Accusations About Me Here On Az Even If They Were Completely Untrue Id Have To Say That Most Az'ers Here Would Believe Him. Am I Wrong? What I Have Just Said Is The Complete And Honest Truth.

Do I Tell This Guy Tough We Had A Deal In Place And What Is Done Is Done? Or Do I Keep The Peace And Return The Cue Even If It Pisses Me Off?

I'd personally just ask them to send my original cue back with case. Upon receipt I'd send his cue back.

Of course I wouldn't have altered the deal to begin with, so it would have never have happened.
 
It's a tough read when every word is capatilized.

Just get your cue back and avoid dealing with this person in the future. Sounds like you gave him every opportunity to complete the deal.
 
I had the same thing happen with a cue I sold on a few occasions. You never know just how picky someone is going to be. That is why I always say - if you don't like it for whatever reason you get a full refund. Until I get an all clear - I don't cash the check, period. Sounds though like perhaps he gave you the all clear, then the next day decided he didn't like it. That is a bit suspect. If he said it was good to go - then it should have been. He should have thoroughly inspected everything he was looking for before agreeing.

All in all though, you should send the cue back. If he's not happy then it is the right thing to do. But, you don't ever have to do another deal with him again - and you should put his name on here so he can tell his side of the story, or people are just going to assume who it is, which is just rude. There are quite a few "power sellers" here on AZ.
 
i know i have dealt with you a few times and it was always flawless.i wouldn't let it get you worked up.just let them cancel the deal and forget it,but remember never to buy from them again.they are the cue dealer not you.you don't nedd them,but they do need you.
 
You tell the person that you did the deal with to ship your stuff back and upon its arrival with the money to cover the cost of your shipping originally and reshipping of the cue back to him and then you will send his cue back. Then you strike it up as a learning experience and to never trade with that person again only do straight up cash deals with them.
 
I agree with cubswin and others. Get your cue and case back, inspect them, and return his cue with him paying shipping. Chalk it up to experience. Stuff happens....

In my experience here, the person you are talkng about will come forward and tell their side of the story.

Following your story as presented, it sounds to me like you had a finished deal as of the Dec. 14 acceptance, the exception being was that you could void the deal if you didn't like the cue he sent you. I think I would cooperate myself, but you are well within your rights not to.

You have completed the deal much to the sellers advantage. I would inform him that the deal is complete and if anything further is to be done that you must be reimbursed for any changes now or in the future. Set your price and let him respond. End of conversation.

I believe the seller has the right to call off the deal if you did not disclose to him that the cue was 59 inches.
That could be his only basis now for returning. If you told him than its up to you from here. He did agree to cover the return shipping though.

I would not try to "FORCE" the deal. Get your cue back, and your shipping expenses. Then send his out and be done.

I chalk it up to experience. I have excellent luck with the group here and have done lots of deals but if deal is bad on either side, just get the orginal stuff back and move on.

Don't dwell, just move on, it isnt life or death, remember that.

I think you both should have asked questions,i mean you can describe something to the best of your ability but you will see vague descriptions on here and then you need to ask questions,if something says good condition then i know it has some scratches and maybe dings so i ask,if it says excellent then i dont expect that but it doesnt hurt to ask.As for the cue being 59 inches i guess that could void the deal if it wasnt disclosed but then again questions should be asked also. :cool:

Get ALL of your money back. Don't listen to his bs threats either as I could probably guess who it is and the guy always tries to get more money whenever he does a deal, that is the only way he makes money on the out. I don't usually get in to this but it happened to me as well. A dealer asking for $25 for a re-tip is about the biggest bunch of BS i have ever heard.

I would say it would matter, Exept that the guy had it in his hands to inspect before he shipped out the cue he was selling.
Once he shipped it he sealed the deal! good or bad, If he regrets it tough sh*t.
If you are happy with it, keep it and tell him/her to learn from this and move on. if you would like to undo it make them pay for every single cost you endured in advance including future shipping costs in advance.
Dear god, they had you'r cue and cash in hand before shipping it out?? this was the time to make a revision of the agreement, or just send it all back and apolagise. once they shipped it THAT WAS THAT!

I just had a VERY VERY WELL KNOWN cue maker screw me on a cue repair and have been trying to get it resoved, he will not aknowledge the fu*k up,and is always offering to do some further work for a discount??? he is so loved here on azb, that I have been hesitant to take pics and post the story... so I kind of understand why you may want to just let it go. But in my situiation its just a joint ring made wrong, and does not involve as much time or money as you'r deal.

You are in the right (if you have told the whole story), so do what is best for you at this point,Dont worry about them, and let the them live the decision they chose to make!

I think you should tell us all who you did the deal with... Someone just sent me a message saying it was Gartland. Is this true? I'm not saying that's who it was, Just what someone told me. No offense to anyone.

The only problem I see with your post is not posting the NAME of the individual!!!!!! When you are right, your are right, and you must stand-up for yourself. While it may become a shit storm, if people like this are not identified others will have to deal with the same thing you have.

One thing that is good about this forum, it that shit birds get stepped on very quickly.

Ron, wow, that's some story. It certainly shows how sometimes fooling with cues can be frustrating. Knowing what nice cues you usually have, I can't imagine a new tip job and 1x2 case as the "deal clinchers" in a trade along with a hundy. After he inspected things and shipped things out on his end, if this deal is undone, it should cost you zero out-of-pocket imho. Since it may have been partially your mistake by not reporting the cue was 59" (if that was indeed the case?), I would probably lean toward undoing the deal and just forgetting about it....and forget about any future business dealings with him. Hope things work out in your favor here. Happy holidays to you and yours and hope to see you soon at the SBE. :)
 
one of 2 thins to do.
1.f him and keep the cue if you like it.
2.have him pay for all shipping charges. shipping yours to him and his back to him. you shoul have no loss to this deal whatsoever. but dont ship back til the 125 is refunded also along with shipping and you have your cue back.
