Fraudulent cue seller on ebay

Seller is currently "sellone-bay2", but his account changes every few months.

I mention this because this seller shows up on this forum occasionally selling cues - Aaron Painter of Rockton,Ill. Apparently he makes good on a few transactions, then sticks someone with several hundred dollars, closes his ebay account, opens a new one, and begins the process again. I'm the latest victim - sold me a cue that he had already previously sold. Paypal has since refunded half of my money, but Painter has disconnected his phone and moved on.

We need a spot where we can put these guys on a list so that we can be protected from them...

From Paypal: "Our investigation has concluded that the seller was at fault, and as a result, we have recovered funds on your behalf.$175.00 USD has been credited to your account. This is the maximum amount covered by eBay's Standard Purchase Protection Program."

Sorry to hear about your troubles. Did you use a credit card for this Paypal purchase, or cash from your bank account? If you used a credit card or even a bank check/debit card sponsored by VISA/MC, you can disputed the charge and receive the balance of your monies. Please be aware that if you did use the check/debit card option, and file the dispute, that as a security measure, the bank will cancel that card, and you will need to request that a new one be issued to you...they do not do that automatically. Been there, done that.

Thanks Lisa, yes I used Discover Card, and it's in their dispute resolution process now. I just heard back from the previous ebayer who was sold the same exact cue. He complained about a fraudulent description and sent the cue back to the seller. The seller wrote a bad check on the buy-back and so this guy has also been refunded $175 by Paypal. I'm looking for Painter's address so that I can call his hometown police department.

Fraud, Not The Case.

Hi' I Originally Sold This Cue On E-bay For A Friend. After The Transaction Was Done And The Cue Was Shipped Out I Paid My Friend For His Cue. I Should Of Waited To Pay Him Until I Knew Everything Was Cool But The Cue Was Perfect In My Eyes So I Never Thought Much About It. The Guy Wants His Money Back And I Had To Eat It Now Because My Friend Did Not Have It. So I Told Him To Do A Charge Back With Paypal And They Would Take It Out Of My Account As They Have. I'm Not Sure Why They Refunded Only 175.00 But I Will Transfer Money To Make Up The Difference. I Was Out Of Town And I Had My Wife List A Cue For Me And She Relisted The Wrong One. The Cue I Had Just Sold And Took Back. The Auction Ends The Guy Pays, Now Paypal Takes The Money Out Of My Account For The Charge Back On The First Transaction And I Can't Refund This Guys Money. So Long Story Short Because I List This Cue For My Friend Which I Will Never Do Again And My Wifes Mistake I Get Sandwiched Between (paypal),the Buyers Which Was Suppose To Only Be One Buyer, and My Friend Which Does Not Have The Money To Refund, That I Gave Him For The Sale Of His Cue. ( I Do Not Screw People And Everybody Here Will Get There Money Also. I Do Not Screw Lie And Jack People Around. Anybody That Has Done Business With Me Except This F@#@ Up Mess Has Never Had A Problem. You Guys Are Out There, So Speak Up. This Problem Will Be Fixed In A Few Days. To Those That Were Shorted On There Refund Please Post A Balance Of What You Are Owed So I Can Finish This. Thanx Aaron

Well, I have never bought from Aaron, but I have to say it's pretty big of him to chime in with the promise that it will be made right. He could have easily stayed in hiding. That's good stuff, Aaron.

But the thing about DPKs, they had to be accompanied by papers to be properly claimed as one isnt it not? So many of the Franklins has been mistakenly, or fruadulently passed on... this is not the first time, and certainly wont be the last that a so called DPK is in fact an old SW. Frankly i wont take anyone at his word its a DPK, unless there is paper proof.

I'm still out $148, but this shouldn't be news to you - my communication has been clear and persistent. You know the other guy as well - he spoke with you 1/2 hour ago and his complaint of bouncing refunds is the same as mine.

It Is News To Me.

I Just Found Out. I Have Not Checked My E-mail Because I Have Been Out Of Town On Business. As You Said I Just Found Out About Ahalf Hour Ago. Also, The Accout That I Have Taged My Paypal Account I Do Not Keep But A Few Bucks In. So Because Of This Paypal Charge Back Not Going Through Paypal Kicked That Bank Account Out And I Have To Set Up A New One. You Know,,, Look, This Will Be Resolved And You Will Be Able To Report This Being Fixed. It Is My Fault And I Except Full Responsibility For This Problem. I Should Have Waited To Pay My Guy And Made Sure Everything Was Cool Before I Did. Please Be Patient Andf This Will Be Resolved. It Will Not Go By The Wayside And Be Blown Off. Thanx Aaron

Aaron, I'm glad to see you will be making this right. I will be following the thread to see the buyer posting that he was in fact refunded for my own curiosity.

Unfortunately Aaron the only experience I can relate about you is that you were a horrible seller to a friend of mine. You claim to have mis-shipped his cue (but didn't provide tracking information to backup your claim). You then took a long time to re-ship the cue, at which point you opted to use the cheapest, slowest, non-trackable shipping method rather than what had been agreed upon. Rather than being apologetic, your attitude was arrogant and put out.

Even here, you say you are going to make it right, but you call the buyer "F@#@ Up Mess"... Seems to me he did everything right as a buyer. You got your money, he didn't get his item, and now he is the one who now has to go through grief to deal with YOUR mess.

So we have at least two examples here of where the buyers held up their end of the bargains, you messed up, and no apologies on your end. Why on earth would anyone want to buy from you when there are so many great sellers on here?

Error

I Did Not Call The Buyer A F@## Up Mess. I Called This Situation F#@#up Mess. I Take Full Responsibility For This Mess And Will Fix It. Your Friend Which I Assume Is The Japan Deal Was Not My Fault. It Was The Post Offices Fault And Ya, Your Right I Already Had 48.00 Dollars In Shipping I Charged 35.00 For And I Had To Conserve. He Got His Product And That Was Not My Fault. When Something Is My Fault I Have No Problem Taking The Responsibilty For It. I Am Not Perfect And Made A Mistake By Selling A Product For A Friend And Paying To Soon And Then Getting Sandwiched. I Am Still The Seller And Must Make It Right Weither I Like It Or Not And Deal With My FriendS Myself. I Ma Not Making Excuses Nor Shifting Anywhere. Just As Your Friend Deal Worked Out So Will This!!! Anybody That Has Sold As Many Cues As I Have Is Going To Have This Stuff Happen Once In A While. The Difference Is What Happens Next. You Will See A Result Along With Everbody Else. Thanx Aaron

It is very good to hear that Painpool intends to be stand-up and make things right. Hopefully, all will work out. I remember the below from another post/issue. It is funny about how things get complicated when commerce crosses state lines.

Since the internet crosses state borders, for internet fraud follow this link:

Note: The previously listed link has changed. The link below is the correct link:

Actually no, now you are referring to ANOTHER deal, because

a) My friend is not in Japan
b) No monies were exchanged for shipping, as it was a trade

So it sounds like there are at least three occasions where you have made mistakes, not accepted responsibility, and ultimately the buyer has to wait while you sort out your mess.

When you say "He Got His Product And That Was Not My Fault" -- that's not a great attitude as a seller. It's certainly not the buyers fault if you mis-ship, and its not his fault if you offered to ship it for $35.00 and it cost you $48.00, is it? Nope!

If I bought a cue from you and you "mis-shipped" it (and then didn't provide proof you ever shipped it) and then re-shipped it with a slower non-traceable shipping method, I would be furious. I think I'll spare myself the grief and just never deal with you.

Just curious Aaron, can you post even one tracking number here that shows a cue that you have shipped that shows the cue being sent and then returned?

PS: I've shipped out a LOT of items on eBay and elsewhere. I always double and triple check the address. I always provide tracking number and insurance so the buyer can see it in transit. And once, and only once was a package lost. I (and the buyer) could verify as much with the tracking. The post office said that they would pay out the insurance but that the package must be missing for 45 days before they pay out. My response? I immediately refunded the buyer their money plus an additional 15% for their grief (since I had insured it properly this was not a problem). Then I dealt with the post office. It was not my fault that the package got lost in the mail, but the way I see it I am responsible for the product until the buyer receives it and inspects it. Stop saying "It's not my fault!" and take care of your buyers the way you would want them to take care of YOU.

I've done 9 or 10 deals with PAINPOOL. No issues. I'm confident he'll make it right.
