It basically has been in California. Businesses are losing their shirts with many big stores around here reporting shoplifting losses in the 1MM+/year range. If only there was some way to predict that decriminalizing shoplifting would somehow, some way lead to this.

Day before Christmas eve a couple hundred of these innocent teens went on a spontaneous rampage through Wolfchase mall. Stores dropped their gates with customers inside to protect them. You wanna get on your high horse. Go to that mall after dark then tell me about it. And that IS the good part of town.

I think even second degree murder is harsh here. I think the charge should be manslaughter. Sentence the clerk to four years, out in two to two and a half. It turned out to be a very low serial number new army and worth a fortune.

"Accidental death" is pretty much what happens when you shoot somebody below the pelvis and they are inconsiderate enough to go hide in the weeds and bleed out. Any way you want to look at it the thief is at least as responsible for his loss of life as the clerk. First and foremost, he didn't have to steal. Second, when shot he could have sought medical attention. Instead, he went and hid to drink his beer.

The real hitch is that the thief was going in the wrong direction. Need better camera set-ups and see them in time to shoot them in the front. If I had such a business I think I would have a magnetic door lock. Stop them dead in their tracks from behind the desk when the door won't open. Then when they turn towards you, you are in fear of your life and can perforate them a bit.

The clerk should be subject to the penalties for shooting and wounding the thief. When I think about it more, the thief killed himself when he chose to run and hide instead of seeking medical help.

As a fellow shooter, marksman,ceritifed firearms instructor and range master, former loss prevention manager, and current secure transport agent I couldn't disagree with you more on fault for the death. The shooter had the both the opportunity and DUTY to report the shooting and did not.. The kid in pain from being shot is not going to be thinking clear headed and be in shock which excuses him from making wise decisions. I saved a life of a kid bleeding out from punching his hand through plate glass and know how critical timing is to find the downed person.

I hold people accountable for the improper use of a firearm and in this case ignorance of the law is no excuse for his taking a life. I completely know how frustrating it is to know you are losing product and the choices are limited to combat it, but NOWHERE is the choice of shooting someone for theft a viable option. There are many ways other than the use of a firearm to prevent theft and secure a business than shooting a teenage perp. If a police officer did the same, he would face similar charges and conviction.

Ever seen the videos of where a group comes into a jewelry store to rob it to find out that the doors have electronic locks and they can't get out. We agree on that as I have seen the same in small mom and pop shops in seedy areas of town that perps know exist because the owners use them to prevent too many people coming in and boosting.

Lastly the clerk was 100% guilty of committing a felony and knew it as he intentionally failed to report it. That in itself is a doubling of his guilt. Had he reported it... the kid might have been found by his blood trail and lived. That tells me all I need to know. 2nd degree is the least I would have charged him with...

Yay Austin!! We are a city that is trying to be Seattle/Portland or almost any of the big cities such as LA in California. Our mayor just returned from touring those fine cities to see how they are handling rampant homeless issues. He liked what he saw as it confirmed his and the councils policies were on track...basically the same as theirs now!
