The media and racist are the ones that are making this about race. Do you think the family of the thief would feel better if a black man had shot him? Do you think the clerk wouldn't have shot a brown thief?

The appropriate use of a firearm is a separate question.

There should be consequences for actions...although I will admit the punishment was

It's a tough spot for small business owners. He is probably getting robbed blind and losing everything he has because of shoplifters. It's hard to work day in day out on a business and have someone come and just brazenly steal stuff from you.

I'm sure that kid and other people use that store as their own personal refrigerator.

The thing is, the police won't do anything in most cases anymore. The police wouldn't have done anything to that kid. Yet the shop owner is still out the beer. Yeah, it's only $2, but why does everyone ELSE get to decide how much that $2 means to the store owner?

So the thug's life is worth more than $2. To whom? Who is going to pay it? Not me. And not the store owner. Are you going to pay these small businesses back for the shoplifting loss? Of course not.

Yes it was stupid for the guy to shoot at him. But I get the frustration.

that store will have fewer shoplifters from now on... that clerk was just reinforcing the concept of private property... a little heavy-handed and heartless, but he did provide a life lesson to all the future criminals in that part of the 'hood

stealing someone's property doesn't mean you also get to tell them how they should react... caveat clepta (thief beware)

First off, to get the two dollar beer value out of the way, I owned a business that people regularly pilfered from. Get caught, you go to jail if you are lucky! I had a .357 and a 12 gauge riot gun I kept handy. Anytime somebody asked me if I would really shoot somebody over a five dollar part I told them that the thief set the value on his life, not me.

I think even second degree murder is harsh here. I think the charge should be manslaughter. Sentence the clerk to four years, out in two to two and a half. You don't expect to do somebody major damage shooting low. I know of a couple cases of bad results besides this. A MP with a full jacketed forty-five shattered a femur, I don't remember if the guy lost his leg or not but with medical attention close by he lived. When the guy at the gate says halt or I'll shoot he ain't just awoofing! Obviously, all good for the MP. The other incident was two ranchers arguing over a fenceline in west Texas. One got irate enough to go for his gun. The other one shot him in the thigh deliberately. Unfortunately he cut a big blood vessel too and the guy bled out in short order. The law in Texas understands these things happen. I think it went down as an accidental death, no charges. Fortunately the rancher kept his pistol. It turned out to be a very low serial number new army and worth a fortune.

"Accidental death" is pretty much what happens when you shoot somebody below the pelvis and they are inconsiderate enough to go hide in the weeds and bleed out. Any way you want to look at it the thief is at least as responsible for his loss of life as the clerk. First and foremost, he didn't have to steal. Second, when shot he could have sought medical attention. Instead, he went and hid to drink his beer.

The real hitch is that the thief was going in the wrong direction. Need better camera set-ups and see them in time to shoot them in the front. If I had such a business I think I would have a magnetic door lock. Stop them dead in their tracks from behind the desk when the door won't open. Then when they turn towards you, you are in fear of your life and can perforate them a bit.

The clerk should be subject to the penalties for shooting and wounding the thief. When I think about it more, the thief killed himself when he chose to run and hide instead of seeking medical help.

Legal experts believe a 75-year-old man who authorities say shot and killed a 14-year-old during an attempted car burglary in the man's driveway is unlikely to face charges.

Lake County Sheriff's Sgt. Chris Covelli said a preliminary investigation into the shooting indicates the man feared for his safety and the safety of his wife inside their home near Old Mill Creek when he opened fire early Tuesday morning. The man told investigators that when he confronted a group of teens in his driveway at 1:15 a.m., at least of them moved quickly toward him, carrying something in his hand. The 75-year-old fired more than three times from a "small-caliber revolver," striking the Chicago 14-year-old in the head, Covelli said.





Authorities later recovered a "Bowie-style" knife at the scene.

Illinois requires an element of fear for one's personal safety when using deadly force, legal experts said. State statute does allow use of deadly force against the commission of "forcible felonies," which includes burglary, but legal precedents set a different standard, attorneys said.

"It's on the books, but you're not going to see it recognized often," said Dan Herbert, a criminal defense attorney who represented former Chicago Police Officer Jason Van Dyke in the shooting death of Laquan McDonald. "A lot of courts have said the use of deadly force has to be reasonable, first and foremost."

Shooting someone to keep your car from being stolen would not be considered a reasonable use of force, Herbert said.

"Illinois is not among the states with very liberal laws in regards to defense of property," said Hugh Mundy, a law professor at the University of Illinois-Chicago John Marshall Law School. "There must be a reasonable belief that his life was in danger to justify the use of deadly force."

Lake County State's Attorney Michael Nerheim announced murder charges against the five teenagers who were with the boy when he was shot. The state's felony murder law allows prosecutors to charge accomplices of felonies with murders occurring in the commission of those crimes even if those accomplices didn't actually kill anyone.


No mention was made of the homeowner being cleared of any wrongdoing.


However, criminal defense attorneys believe that determination will be made following the results of the boy's autopsy, which is scheduled for Wednesday.

"He could not claim he was acting in self-defense of himself and others if the wounds are in the back," said defense attorney Phil Nathe.
