I interpreted CC's comment to mean that he was concernerd about the
state of Kentucky (Blue Grass) applying taxation (green) without (how much) representation (after for you)

I was sorry to see the thread turned into an Attach on Mr. Gartland. Also California tries to tax anything bought in Califorina, or sold on the Net, or by Mail Order out of California.

Unlike most people selling cues, I declare the income that I receive when doing so. Because 99.9% of everything I sell is shipped out of state, I am not required to collect any sales tax on any cues shipped out of state, but am required and do file a form with KY stating the same. I have no idea what the laws of other states are as to declaring taxes for receiving property in State A when it is shipped from KY where no sales tax is charged or collected in KY. I do not collect sales tax for cues shipped out of state because there is no requirement that I do so. If I were to collect sales tax for cues shipped out of KY, I would merely be charging more for the cues with no obligation to remit the sales tax to KY.

I believe you and I are saying the same thing, just from two different perspectives. I was referring to KY and the laws required when purchasing and you are speaking to the same laws when selling.

I just confirmed with my Kentucky CPA that no tax is due by me or any buyer of any cue that I ship from KY to another state or country. And that makes sense because it would violate the Commerce Clause of the U.S. Constitution for KY to tax an out of state citizen for goods shipped from KY to another state. However, if you buy an item and it is shipped from one state into your home state, you would most likely be subject to "use" tax in your home state, but nobody on the planet declares use taxes. Enough said.
 
I have dealt with mike and has been a great experience. He is an honest seller with good communication. Never had any issues like this.
 
It's just like when you buy something on the Internet and it says "California residents must pay addtional 8% sales tax". That is because the business is licensed in CA and is required to charge tax to anyone in state.

I know its not pertinent to this thread, but the sales tax here in my F'd up state is 9.75%

After receiving a tax due notice for a purchase.
Mike Gartland aka Quality Cues, instead of paying tax on out of state purchase, files a form in The State of Kentucky saying they are not responsible for the Sate tax amount, you are!
Whether you realize it or not when you buy a cue from Quality Cues, you owe tax ON TOP of the purchase price.

Is the 58 Standard sold. If it is the one I am thinking of it is :(. It would look sweet next to my 69 GoldTop!!

Regarding the responsibility of sales tax..

The company I work for does retail and was audited last year for WA sales tax. We had found that even though some of our customers were set up for tax exemptions, this was not always found to be true (expired licenses and so on). Our company was on the hook for the sales tax. The sales tax is the responsibility of the seller, not the buyer. We now require all resale certificates prior to sales in which sales tax is claimed to be exempt. No form = sales tax applied. To top it off, if they did not have their forms in, they then must request their taxes back from the state, not from us. :p
