Hard to say. I worked with a guy who's father founded a known tool company. The other son found a way to steal the company out from under his father and cut the entire family out somehow. I don't know the details but swore off the brand ever since learning about it. Most every mechanic and machinist has a set of their tools. Must have been worth millions. I have no idea how it was done, how it stuck, or if/why the family sought legal council. It happens.

Civil law is expensive. That is why it is often worthless getting a patent. Someone can just knock you off and tell you to go to hell. A patent fight cost tens of thousands. And you don't have to win.
To be honest, now that you are out of it, I can't believe you actually made any money with it.

You always have the next think ready to go and don't put all your eggs in one basket. Time to do it again. Make a few changes create a new name and image and you're off and running.

I wrote my own patent and filed it and prosecuted it for a total of $850. It took practice and I know not everyone can do this, but it is worth it for that price.

You are right about defensibility. It costs too much to litigate. But owning a patent is literally owning private property, and it can be transferred, sold, and negotiated upon, plus it shows you are serious about an idea.

(Btw trademarks are even easier, only $250 something each. No need to pay a lawyer, you can do it all yourself.)
