Hard to say. I worked with a guy who's father founded a known tool company. The other son found a way to steal the company out from under his father and cut the entire family out somehow. I don't know the details but swore off the brand ever since learning about it. Most every mechanic and machinist has a set of their tools. Must have been worth millions. I have no idea how it was done, how it stuck, or if/why the family sought legal council. It happens.
 
NOTE: to all who will listen.... The LAW does not care, if you are breaking the law, unless you are bothering them or someone who complains. When someone complains, they have to seek relief with an attorney. If you can't afford an attorney, then you can't afford to get any JUSTICE. I am at a low point in my life, so I am just floundering. No attorney will give me the time of day, without being paid to look at his watch. So that's that. Mr. McGee is a wealthy man, so he has no problem paying for Justice...?
Civil law is expensive. That is why it is often worthless getting a patent. Someone can just knock you off and tell you to go to hell. A patent fight cost tens of thousands. And you don't have to win.
To be honest, now that you are out of it, I can't believe you actually made any money with it.

I wrote my own patent and filed it and prosecuted it for a total of $850. It took practice and I know not everyone can do this, but it is worth it for that price.

You are right about defensibility. It costs too much to litigate. But owning a patent is literally owning private property, and it can be transferred, sold, and negotiated upon, plus it shows you are serious about an idea.

(Btw trademarks are even easier, only $250 something each. No need to pay a lawyer, you can do it all yourself.)

When I got my patents a provisional for a micro entity was only $86.

This is my business model. License IP/tech for royalties with option to buy.

I looked up how much I actually paid. Provisional for micro was $70 in 2020, and everything combined was $765. It is cheap if you know how to write a good patent and make the diagrams.
