I would not call a foul on my opponent in that situation if he had done the same thing. It is clear and obvious that he wasn't intending to strike the cue ball to make a legal shot. He was not down on the ball lining up. He was moving it into position.

Sadly, that is the issue with capped tournaments, as well as leagues. If there is a rating system, someone will find a way to game it. It is very disheartening for the semi-serious amateur that wants to compete in these if you are an honest person.
