Insurance advise

I recently sold an old cue from the 80's. It was an unused cue that came directly off a dealer's rack. I had photographed the cue, examined it and everything seemed fine. When the buyer received the cue, he indicated that the shaft collar was cracked and there was a crack in the joint. I asked him if he thought the damage could have come from shipping. He indicated that there was no way it could have happened during shipping as it was well packaged and he was returning.

I have no problem accepting cues back that were not exactly what the buyer was expecting, especially, when it comes to old production cues.

In this case, I went to the PO to pick up the cue and it had been returned in the same tube I had sent it in. Though, upon seeing the package, the tube had a big hole in the side. I asked about insurance on the package and the PO clerk told me it had been sent back without insurance.

I was not going to accept and walked away from the counter to think a bit. My thought was as to how stupid this was to return the cue to me without insurance. Do I let it go back to him for more misgivings or do I take it and figure out what to do? It is not a big deal, but it is a $450 cue. I returned to the counter and asked for the package again. I asked the clerk if he would verify whether there was any damage inside? He said OK, but that it wouldn't make a difference. When I open the package at home, the cue had been scuffed where the tube had been penetrated. The implex joint had a crack almost half way down the side, but there is no way I would have ever missed seeing this crack.

Now I have a cue that will take $200 or more to repair.

My concern is should he and or I have filed an insurance claim when he received the cue, because the joint was not cracked when I originally shipped? And how am I to handle this damage on the return? Or am I just flat out burnt? Or do I issue only a partial refund? I don't want any trouble. Just want to do the right thing.

I am a bit perturbed, to say the least.

Any suggestions?
 
Did you return the money? I have a claim pending with the post office right now and if he had damage, he could have filed a claim. If he says it was damaged when he received it, you may have a chance. If he says it was not damaged, I think you are SOL. I can tell you that I was disappointed in my cue arriving with damage and it was no where near what you are describing. Good luck, John
 
I would send him a 100 dollar refund and ship him back the cue. tell him you want to split the cost to fix it. because he was NEGLIGENT in failing to inspect the package when you asked and was NEGLIGENT when he shipped it back without insurance.

By your estimate its a 200 fix! You would still have made a 450 dollar sale and with the 100 refund you cleared 350.

The guy is going to WHINE but i believe if he would have paid the $2.50 on insurance he would have gotten a FULL REFUND!!!!

He may be able to find someone to fix it for less than 200 but thats on him!

ok my question is What kind of cue are we talking about and where did you get this estimate at? $200 to replace an implex joint and buff out a scuff is really steap to say the least..
