Quite true..anyway not to thwart the thread with too much cabbage..the designer must prove the element of 'copying', in this case the cuecase design, that the alleged infringer has/had actually copied his/her works..but by looking at the pictures we can't really tell who copied who..

I know it has been touched on, but is there any suggestion that the cases designs we are talking about are anything other than public domain?

If so, how can something that belongs to everyone be infringed?

Just curious.

Not easy..I can even point at some websites and say that design is done by me..moral rights, which exists independently of economic rights, are only personal to the designer. As pointed out by someone earlier, if no protection was in force, LEGALLY anyone can use it.

That's why the patent honchos struck off computers and televisions..because the whole world is using them there's no way to protect the design only the softwares (copyright). In this case the cuecase designer must first apply for protection for his/her works, in order to take any action for infringement. After reading all the pages, I don't think either of them did protect their designs..so neither of them can have any actions..even protected creations people also smuggle pirate and use..
