Is it true that the ball closest to the head string is spotted if no balls are past, and someone scratches but has no balls? No pun intended.

If someone owes a ball and doesn't have any, they owe one.

I understand that but suppose your opponent scratches and has no balls to spot. If no balls are past the head string are you supposed to kick at a ball behind the head string? That does not seem fair.
Yes the ball thats closer to the head rail is spotted.. If there two that is equally close then the higher number ball is spotted..
