Snooker rule question.

I was watching the 2009 masters final between O'Sullivan and Selby. In part 30 about 4:52 into the video O'Sullivan plays safe by going one rail and lightly nestles into the rack, then Selby plays safe and doesn't hit a red. Why isn't this a foul?

The ref called a "touching ball", so Mark already has touched a red before he even shoots.
