I hate to see these types of threads. My experience with Jeff has been absolutely amazing, he's followed through with perfect results on every cue he's made for me.

He's always delivered on time, never taken a deposit and has been great with communication as well.

It's unfortunate to read such things but I can say for a fact, from my experience, Jeff builds more cue for the dollar than any other cue maker I've ever come across.

Hope things can be smoothed over for all parties. Just giving my experiences, that's it. Nothing more to read into my statements.

All verbal agreements made anywhere are binding...

The only thing is that verbal agreements are impossible to prove when there is contestation as to what the verbal agreement entailed.

Not exactly true. I believe there is a commercial code that defines when a verbal agreement is, and is not, enforceable by law. For example, I don't believe verbal agreements involving the sale of real estate are enforceable. Texas certainly is not the only state that enforces any kind of verbal contract.

Its amazing what the allure of money can do to people. Im sure the OP held Jeff to the same high position you did, or he wouldn't have bought 10 cues from him.

Everyone, Remember these facts.
1. He called me on Wednesday to see if I could come up on Thursday, I told him I couldn't it would have to be the weekend. He said that was fine.
2. He called me on Saturday around 2pm to see when I was coming, I told him it would have to be Sunday evening. He said that was fine but to call first before I came.
3. I called Sunday evening at 8:19pm. He did not answer so I left him a message Explaining that I had for got and would be there Monday night. (sense he didn't answer, maybe that's why he wanted me to call first<<< incase he had stepped out for the night???????
4. He already had sold the cue before # 3 happened.
5. He finally called me back and explained why he sold it, and when I asked why he didn't call me to tell me he was selling it. HE said I called you 5 Fuking times already you stupid Fuker!!!!! then hung up on me.

I did nothing wrong in this transaction, but gave my son a fantastic birthday weekend.
Would not change anything I did at all.

To be fair, you told him you couldn't come Saturday but he had to call you at 2 PM on Saturday at which point you told him you couldn't come. Why hadn't you called him earlier as you knew at that point you couldn't come? You told him at that point you would come the next day, Sunday, but waited until 8:19 PM to call him and tell him you couldn't make it. I'm not making a case that totally excuses Olney but to be fair, you didn't exactly bend over backwards to keep Olney informed of what you were doing either. Sounds like you were less than precise and on the ball with your communications. Again, this doesn't TOTALLY excuse Olney IMHO but it does cloud things up a bit. Had I been Olney, I'm not sure I would have sold the cue but I'd be less than happy with you for not communicating with me better.

You can call me whatever you want, you had ZERO deposit on that cue and he gave you plenty of time to get it or it would be sold to someone else.
This is his story and I believe it, I have bought 28 cues from him and never had any issues.

Forgive my ignorance here but what is the difference if any money was put down towards the cue? The OP was the person who worked with the cue maker and provided the specs. Unless the OP was planning on not paying who cares if money was put down or not.

Trust me, it was killing me to not be able to Drop my Family and go pick up my NEW cue.

By no means am I implying you should have dropped your family to pick up a cue. Just sounds like the communications was a bit loosey goosey which falls on both parties. I did miss the part where you didn't state Saturday but stated the weekend.

A better explanation from Olney would have been "I am sorry, I tried to contact you, someone offered a boat load of money for the custom I built you so I sold it. I hope you understand. I will start another custom for you right away, let me know what you want, you will have it in 6-8 weeks at no charge".

It's refreshing that Jeff himself is not disputing the facts that the OP presented; rather, he's arguing that selling the OP's cue out from under him was perfectly okay. What a joke...and another AZB cuebuilder bites the dust.

Save yourself a lot of heartache and never make a deal to buy a high-end guitar, motorcycle, painting....heck, just about anything you can think of.

While I wish the world were different, the reality is Cash Talks, B*llsh*t Walks.
I'm speaking about the regular business practices by the larger majority.

This is not how a legitimate business goes about delivering or failing to deliver a product.

I've made numerous deals on high end cues, guitars, bikes, cars, art etc just as you mentioned and the reality is that the "larger majority" of people running a legitimate business don't operate in any way close to how this deal went down.

There isn't anyone with any sense of how to run an honest business that would condone selling products out from underneath a buyer without some kind of paper trail that exhibits the sellers efforts to complete the deal. If he had attempted to deliver this cue for 30-45 days I might think differently but a few days over a weekend is garbage.

We've all dealt with crappy buyers, excuses and slow payers but its not an excuse to be a crappy business owner.

I'm not piling on you, don't take this the wrong way but you have taken the time to start a thread knowing it will damage the reputation of Olney and probably cost him business but at the time it was so insignificant you forgot.

It seems to be a much bigger deal now than it was when you had the opportunity to buy it. Is it possible when you discovered somebody else had bought the cue it suddenly because a bigger deal than when you thought you were the only one interested?

Please read all my posts. Bigger deal cause someone else bought it? Opportunity to buy it? Read previous post. No one should have had the chance to buy it after at most 4 days. Come on man.
It's a big deal because I had been waiting for the damn cue for so long. I was excited to get my New Olney I had designed.

I think way too much time is spent on the exact actions of the buyer. We have all we need to know when the seller admitted that he was willing to sell an ordered cue out from underneath someone in less than a week if you don't respond to his liking.

I don't care what the buyer's excuse is, that's not an appropriate way to deal with a slow buyer and slow payment. Hell I wouldn't even consider it a slow pay until at least 15 days.

Even more so when these guys rarely deliver on time or give any real notice as to when the order will be completed.

The late Wayne Holmes was one of the best about communicating timeframes and giving customers the heads up on completion dates...and then delivering to his word.

These guys expect us to deal with month(s) delays but are willing to burn a bridge after 7 days over a weekend. Come on now.

and to the OP's credit he has more kids than Adrian Peterson so he was busy with family time and just forgot to call back in the timely fashion!! :D

Not when you've been communicating consistently for 4 years! Life happens and one day is nothing. This is not good business if true. Following. I've wanted an Olney cue as well but if this is accurate not so much any more.

You were so excited after 5 phone calls from Olney you still blew him off and didn't show up to get the cue on the day you verbally told him you would be there.

I'm an outsider looking in - I don't know you or Olney nor do I own any of his cues - I can tell you what I would be thinking. I would be thinking you can't come up with the cash for the cue and with a choice of calling you for a sixth, seventh, eighth time or selling it to a cash buyer that cash would be very tempting.

Olney evidently disputes your claim he sold it for 4 times what you were going to pay. Where did you get that information?
