They aren't. It's open to interpretation and solely at the discretion of the agent.
NOPE. 100% wrong here. Have you followed ANY of this saga? The total allowable time spent here is up to the individual immig. agent. Done on a case-by-case basis. No set rule on the total time. I've been told that 65% is kinda of a rough guideline they go by but even that is totally up to the whims of the officer you get. Long stays here and short stays at home is what gets you in trouble.
Well DHS is at times a pain in back side to deal with, have to remember not all agent have year of experience to fall back on.
Then you have new agent who just don’t have years of experience.
Thing is DHS detained Dennis for a while, sure some supervisors got involved, and made final call.
Now his legal team is work to help the guy.

So are you an expert on DHS Policies, Visa, and all the paper work involved in doing hing right. Every time I do something involving a federal agency I check thing out so I do get no surprises.
I buy bicycle part all the time out of UK, France, and Italy. First tome I did I check out the duties, and how much you could import without duty. Sure made life simple a couple phone calls to Customs Service, to keep from paying duties.

laws are purposely made not to be black and white. otherwise there wouldn't be leeway in enforcing them due to circumstances.
it never is fair and when it hits close to home. it hurts as in this case with dennis.
if dennis had been from iran or afghanistan and not friends with people, would there be this uproar. likely not. so when it involves someone we may root for it gets personal. and that's natural.
dennis and his friends have to fight it out and hope they win. it is tough to win against the government so it is a big victory if they prevail. good luck to them.
