This was not a tournament game, just a friendly match. Opponent broke and scratched. I get ball in hand, but, the 1 ball was against the rail with 2 other balls , one on each side of the 1 ball about 45 degrees on each side of the 1 ball. There was no way either of us could hit the 1 ball first without breaking up the "mess".

I could have played a safety, purposely missed, and given opponent ball in hand and he would of done the same, given me ball in hand with his missed safety.
We mutually decided just to rack em and rebreak since it was a friendly game.

According to the rules (as I read them) if this went back and forth the first person to shoot would be the first to get 3 consecutive fouls and lose the game.

If this had been a tournament game should I have sucked it up and broken up the 3 balls and give my opponent ball in hand by not contacting the 1 ball first and hopefully not given him any kind of shot?

Your opponent was on one foul for the scratch. You should have hit the 7 ball softly up against the cluster, making it worse. That's a foul. You are now on one foul.

Your opponent can't hit the one. He fouls. He is now on two fouls. What he should have done is broken the cluster apart on his second shot. If he doesn't, you take ball in hand and make the cluster worse. You are now on two fouls, but so is he. He has to shoot. If he fouls, he loses.

He then surprises everyone by jacking up a little, shooting the cue ball straight into the cushion with lots of top spin. The cue ball then jumps nearly straight into the air and comes down on the one ball for a good hit. The cue ball then rolls over and freezes behind the 8. (There is actually a video somewhere of a player getting out of a safe like this.)

On his second foul, Luong takes an intentional, moving balls away from the cluster. One problem is that he does it with an intentional double hit. That's potentially an unsportsmanlike stroke.
 
well actually you could have rolled out or "push" and he would have been on second foul if he didnt see what you saw! or he would of passed back and either way, he would of 3-fouled first.
