Michael Brewster... Worcester, MA 01610-1908
- Ebay member: spo210sw

Case situation:
this is original deal: http://www.ebay.com/itm/McDermott-c...D&orig_cvip=true&rt=nc&_trksid=p2047675.l2557

This cue value was confirmed by Jayme from McDermott months ago. Butt was in mint condition as I received and shaft have marks of use. I bought it from Joerackem in 2013, and I was keep it safe in bag.

First bidder not make payment, so I sent second chance offer to spo210sw

Item sold for 91$ + 25$ shipping
Delivery time, in shipping method selected by buyer: 12-17 working days, tracking included. Not insurance.

Payment received: 09 December
Item shipped: 14 December (10 was holiday, 12 and 13 Saturday and Sunday - Post closed)

Tracking number: RD680037652PT
www.track-trace.com - tracking number works. Not usual, in this time, item passes for Airport in UK before shipped to US.

At 7 January, without any previous message, I receive notification that ebay case was opened for "not received item"
It was weird for me, because just only passed 11 working days (23/24/25 Dec and 31/01 Jan was holidays here). But, in same day, I answered; "Hi Tracking number: RD680037652PT USPS.COM not show it yet... I will call post office to know something tomorrow."

I was checked in post office and they told me item arrived in US at 6 January.

(see picture with remaining information about case)

case

After this, I make claim in Post to know what happened... In this time frame, buyer not received refund yet..

My surprise when I got answer from post:
Item delivered in 22/01/2016. 22 working days, it´s true, but it´s my fault delay? Christmas? Who knows..

Oficial document of delivery confirmation

Delivered in 22Jan and buyer receives money refund in 25 Jan... Why he not told anything?!

After this:

02/02/2016 - I sent first e-mail...
Folowed by more e-mails in dates: 11/Fev, 21/Fev, 25/Fev, and today... Never got answer

By ebay, I sent messages in 26/Fev and 4/Mar.. Never got answer

mails

If the Guy not happy with cue, with not answer? Why not tell? And If happy, why not re-pay?

This is not correct atittude!

I know him. How exactly did he steal $125 from you? I've know Mike for almost 20 years and he is one of the most honest people I know. That being said he can be somewhat difficult to deal with at times but he would never intentionally defraud or steal from anyone. So please enlighten us as to how exactly he stole from you. Because just posting this up like you did is complete bullshit without the backstory.

LOL! Ok, Tom, you would be the best guy to help then.

I'm hoping so. But whenever you see something like the original post in this thread there is always more than what is being said. I am patiently waiting for a response from the OP.

Oh, I agree. We need more than just what OP posted.
OP, please give more details on here or in PM if you prefer.

I spoke with Mike regarding this and he will be contacting the OP to discuss a resolution later when he gets to work as he does not have internet access at home.

I won't get into it but to say that the cue was grossly misdescribed, the tracking number given was invalid and after over 2 months it still hadn't arrived, and the OP went out of his way to mislead any potential buyers of the cue by not describing it correctly.

Additionally, the amount the OP stated he was out is actually $96 UDS ($71 for the cue and $25 for shipping) Also, if the OP had insured it correctly (per Ebay policy) he would have received his money from the shipping company considering after 2 months it still hadn't been delivered. Obviously Ebay/Paypal would not have refunded Mike his money if the cue had been delivered and/or the tracking number provided was valid.

This also leaves me curious why the OP didn't bother to contact Mike before posting this.

Aha! A totally different view. I guess OP was not completely open about this.
OP, care to explain why you are trying to trash man's reputation without talking to him first AND without openly stating ALL the facts.

Great someones knows...
So, lets be facts:
- cue was grossly misdescribed - FALSE. Cue model was MG25 metallic red cards, as described, in used condition, with Butt new. I have e-mail from Jayme (McDermott) who comprove model.
- the tracking number given was invalid and after over 2 months it still hadn't arrived - FALSE. Item shipped 16 Dezember and delivered in January. I make claim in post and have oficial document who comproves it.
- $96 UDS ($71 for the cue and $25 for shipping) - not correct.. value was 91+25
- also leaves me curious why the OP didn't bother to contact Mike before posting this - FALSE. I have more than 7 e-mails sent to this guy, in ebay and direct by mail, in february and March.. He bought another item on ebay from another seller after my ebay messages, and NEVER ANSWER ME MORE.

Also, if anyone dont agree with deals, can talk and answer.. not simply keep cue and money and never answer anymore

I can print all mails and informations and put here

Yes, in that case, please post all you have. If Mike is at fault, I am sure he will make it right.
But, until you present hard evidence, this story is unclear.

The shaft has a giant gouge in it right where a blem letters would most likely be, gee imagine that. Also the shaft was filthy and obviously well used. Not a new cues as described in the auction. I will gladly send this cue back to you and list the tracking number here for all to see once you pay shipping as it was misdescribed. Btw you could have just called, my phone number is listed with Ebay. Your move.

Don't know why the OP decided to bring this on to the AZ Forum since this was an Ebay transaction not an AZ. He should be working this through Ebay channels not posting this crap here...we have enough drama on the "For Sale" section.

I agree. Thank you for your input. Or he could have just called me as I'm not always on the computer.

So my question to you is this.....

If the tracking info was correct, why would Ebay find in Mike's favor and return his payment to him if the cue actually arrived as you said it did?

The truth is the tracking number was invalid and the cue showed up much later than it should have and after Mike asked Ebay to step in and return his money. If the tracking number was correct AND it arrived within a reasonable amount of time Ebay NEVER would have returned his payment. So you can see why there is a question whether you are telling the truth here.

Maybe you posted the tracking number incorrectly but when Mike was trying see why his purchase hadn't arrived yet he kept getting a notice of an invalid tracking number with no way to really see if it was on it's way to him.

Additionally you claimed here that you shipped the cue on the 16th of December and the auction was won on the 8th so it was a full 8 days after the auction that you claimed to have shipped the cue when you listed that it would be shipped "1 day after cleared payment".

So how about telling the whole story rather than the one that suits your agenda?

You are lying here. Ebay would not have issued a refund if the tracking had showed it had been delevered as you claim.

Furthermore.... This website/forum is in the UNITED STATES! So if you going to try and provide proof you may want to consider doing so in a language that we actually understand.

And why bother to list the item on the US Ebay site to begin with? There are Ebay sites that are in Europe, no?
