Lee in this case you need to ask for their insurance company. The insurance company is the one who will pay for this claim, if you think it is worth wasting a few hours hassling with. My son has spent countless hours trying to get a auto accident claim settled, by a well known company who wants to drag their heels on paying. My guess is they will give you a big run around and eventually pay if you are persistant. If you get lucky and your own insurance company happens to be theirs also, then you should get paid promptly. Chris is correct. You need to call again and ask that person for their carrier's name and contact. Also ask for their superiors number and speak to them before the insurance. Your best bet is to try and get a couple hundred(guessing) before escalating to the insurance company and be happy. You SHOULD probably contact your insurance company and have them call. That is what they are paid for and God knows they make enough money.
However, here is what you need to know and what to provide them. This pertains not only to the venue, but to the insurance company.
1. They won't want to give you a dime and will try and pry some sort of info to make you look as if you were at fault. They also know that it is a small claim and you more than likely will not want to go to court. If you really want to go the distance....go to number 2
2. The name of the EMPLOYEE that hit your STATIONARY cart. List all details that put them at fault.
3. The EXACT amount of the damage: time and materials. This is where it could conceivably become a waste of your time. If the frame wasn't bent, how much time and effort is a new piece of diamond plate to cut and reinstall? I am only guessing on the process by your pictures.
4. If they still won't cough up any reimbursement, then your only outlet is small claims.
a. Normally a demand letter stating damages, then give them 30 days to reply.
b. File and have them(you sue the venue in this instance, not the insurance) served, wait some more....30-45 days, although they can postpone.
c. Go to court.. WIN and try to collect. Since I doubt the damage exceeds their deductible, you are back with the venue...
Bottom line IMO is work your way up the food chain at the venue.
