Sorry, I did not describe this situation correctly at all and missed an important point. Australian Open Filler-WissenRack 6.
1. Filler broke and failed to meet the 3-ball compliance (one pocketed, one reached the kitchen) and walked away from the table.
2. Wissen looked it over and gave it back to Filler.
3. Filler then played a pushout.
4. Wissen took the shot and played it from there.
So apparently the 3-ball rule applied, but if player #2 passes it back, player #1 can then push out.
