Darn right it could be if I remember correctly for every 6' down the ditch needs to be as wide . Or have something to stabilize the ditch walls , yes I can't remember what they're called anymore . it's been a very long time since I last worked in a ditch for my folk's plumbing company or even for my water well service company .
 
This could be an OSHA course poster/slide of things that should be done & not done. Wow! Hard to believe someone even took a picture as evidence.
In the mining industry, it's MSHA, which has even more rules and more restrictions than OSHA. While working at a gold mine, I recall at least two instances where employees were fired for posting photos taken inside the mine site on social media. The company was absolutely paranoid about some form of MSHA violation being incidentally exposed via photograph.
