No tattoos on your hands either. I knew when I was in prison it was a bad idea to tattoo my hands, but I just HAD to go along with the crowd to fit in.:D

Facial hair? Sounds like reasonable accommodation to me...I will consult with Counsel and return.

Wait a minute, it is in CA. Employer has no chance at defense. Apply immediately!:o ;) :D

I'm not a legal expert, so tell me, is that not a good thing to say?

It's descrimination. You cannot "not" select someone for a position based upon appearance when they can aptly do the job as previously described.

You can, however, get around this by saying you are hiring a "model", as their looks are solely the reason for employment.

Something tells me the EEOC will leave you alone, though.... :rolleyes:

Based on that, I'm thinking I would have it covered.
I was going to have the successful applicant sign a model release.

You have to be able to show that the reason the person is considered ineligible for the position is actually a consideration that is essential to the performance of job duties...you'd have a hard time proving that a pool assistant's performance would be hampered by facial hair. A ZZ-Top beard would be obvious, but what about the well-groomed/ short/ minimal type of facial hair?

You could move your base to VA. We are an 'employment-at-will' State and are more likely to side with the Employer!

All tounge in cheek though, my end anyway. Employee still has to show harm was done...though you are in CA(:rolleyes: )
