Yes it is a legal break shot since 2 balls plus the cue ball hit a rail after contact, or, if that shot was called, he successfully made a called shot.

I posted the same shot on youtube a number of months ago. It's completely legal. Regardless of what anyone says, it's still a flier no matter how much you practice it.

I highly recommend using it against much weaker opponents.
