And you don't think its arrogant to not only tell; but to pass legislation which dictates how the owners of pool halls and bars should run their businesses?????

There is absolutely no law requiring bars or pool halls to allow smoking therefore if the majority of people prefer a non-smoking establishment it is up to the owners to make it so, not the government.

I understand, though.. Sometimes people don't think before they ask a question like this.

Government told the logging industry to quit using mercury in it's industrial processes.

Government tells restaurant workers preparing food they have to wear hats or hairnets.

Government tells Merril Lynch how they are going to record business transaction.

If you can name ONE, just ONE private American business that doesn't have to conform in some way to government control over business processes, then I will gladly chop off any body part you designate.. ANY part.. and Fed-Ex it to you.

NO company can release mercury into the environment.
NO you cant place foreign objects in food to be consumed by the public not just in restaurants but anywhere in the food processing industry
NO you cant process any financial transactions without following government guidelines in order to prevent fraud or money laundering.

While you are setting there with a "BIG Cheshire grin on my face" you might want to consider the fact that tobacco products are uummmm legal.

None of these points you "owned me with" has to do with businesses allowing their customers to partake in a LEGAL activity.

But you seem to be drifting farther and farther away from my original question...tho I hardly blame you,if I contradicted myself as badly as you have I would want to change the subject too.
 
Well, the difference is in one case the law is protecting property rights and in the other the law is taking away property rights.

Actually the point that you seem to be conveniently avoiding is that just like the items mentioned above, it is now no longer legal to smoke in public establishments as defined...

When you wake up and face the facts: It IS no longer LEGAL to smoke in the already mentioned public places then you may be able to come back to reality and have a rational discussion.

Let me guess. You're an angry upset smoker, complaining about having to walk 20 feet to smoke a cigarette.

Now all of a sudden you want to tout Governmental overreaching laws, which you've already been willing to accept for many years previously, until it related to smoking in bars / pool halls. Now you wanna look for every government loophole / violation that you can find to rationalize your addiction.

Your revolution against the government is ringing hollow.

And before you go off on any hypothetical extremification rants, if anyone tries to pass a bill banning your right to smoke in outdoor environments even if reasonable distance away from any public establishments, then there will be many of us, who will vote against such nonsense.

Perhaps the smoking ban on the beaches of San Diego would fall into the category of nonsense.But it hasn't due to the fact people have gotten so used to simply giving in to the anti-smokers no one seems to question their actions any more.

Every one seems to crying that their "rights" are being violated because they cant go into a bar or pool because of the smoke.But when you comes right down to it you don't have a "right" to go to such establishments...its a privilege.This privilege is provided by the owner of the establishment and he does have the right to run it way he sees fit.
 
Could be a Court Battle in the future

Well the 10 o-clock news on the Channel “5” in Phoenix again ran the latest update on the saga of Metro Sports Bar, and it’s allowing smoking.

Per Channel “5” in Phoenix apparently yesterday Metro Sports Bar received their 1st. Citation under the Anti Smoking Ordinance, and apparently County Inspectors plan to visit Metro Sport again this weekend and if the smoking continues they will issue more Citations.

Also reported on News “5”, county Inspectors may issue “tickets” to patron smokers, as the law apparently has provisions to punish offending smokers. Smokes beware it could cost you to smoke at Metro Sports Bar.

I believe the owner of Metro Sports Bar has deep pockets, and also owns several other Phoenix Bars,and business in Phoenix. Maybe it is his idea to challenge what could be in his opinion a poorly written law, and take it to some high court for a ruling in his favor.

IMO I think he will loose in the long run, and spend mucho denaro in the process. but that is his choice under the American Justice System.

In the mean time I understand Metro Sports Bar is doing record business as the temperatures rise in the Valley, and smoking continues to be allowed in part of the building.

You can still smoke there but only in a certain section. It has been like that since day one of the bill passing. I was just there last Saturday and my wife was just there on Tuesday.
