Well Commissions/Royalties vary, but if I did the Sale I got to Keep 100%. If it was done through an Agent it could be 20-70% of the sale. Than you have the Agent who RIPPED Me off for 20-30K in 1995.

So like everything that looks wonderful, sometimes there are Pit Falls. At one time you could make a good living as a Freelance News Photographer, now the picking are slim thanks to 24 hour a Day News, and the Internet.

I do post MY own opinion. But unlike yours it doesn't change cuemaker to cuemaker. The fact is you answered this post in the very begining and you didn't mention a thing about the copyright infrigement possibilities. You and I both know, YOU know what that means and pertains to. The stone cold fact you didn't say anything is only because its ER. Had this been Phillippi, Black, or any other cuemaker, you wouldn't have been able to type your b.s. shpiel fast enough. Anyone can see that. The fact I will come after you when you don't hold your line, is just a by product of your own two faceness.

I know you are seriously biased when discussing ER, but here is the deal.

My personal feelings, great cue, Zack had a great idea paying tribute to 3 of the WPA's greatest players. Fantastic, and he got a damn good cuemaker to do it. Copyright portion of it, normally would not bother me a bit. So really its not about the cue or the content. Also I think the women would be honored and if they had the time to respond would have no issues to the contrary.

Jimbo, the most two faced hypocrite on the planet. He has the audacity to talk design integrity and all this artistic theft its down right sickening. He claims to administer his "feelings" across the board. Obviously thats not the case, as one can see earlier in the thread. Again dating back to the cue design thread its just proof he lets people who have done him favors or cut him breaks, slide. Its wrong. Thats all, he picked the wrong guy to argue with, plus all the lies and bs he needs to stoop to when he cannot win the arguement, has put him square in the headlights.

Now ER, here is an interesting situation. He was a huge voice in the cue design stealing thread claiming "artistic property" yet had no problem copying other people art onto his own without written consent. To me, thats hypocritical. Unlike Jimbo, I do call it like I see it. Unlike Jimbo, I do it to everyone. If Skip or Mottey did this, I would say it. But neither have condemned one action and did it themselves. Now ER can claim that Zack tried, but receiving and asking with no response are not the same. For someone trying to establish a presence in the US market, personally I would think would me a bit more careful with his words. Now I like his cues, just my advice would be make your words match your actions, or vice versa. Thats it.

it's true, I'm biased.
Jimbo is biased as well.
Zack and ER are wrong to use those black and white pics nobody cares about.
We do not have the integrity of the cuemakers whose work you sell.
God forbid, ER gets caught making Gina anniversary cues with Gina logo for a Japanese dealer. And get caught doing it because he wasn't too smart to make just one, and get banished from his elite makers club.
Or make fake Szambottis. I'm pretty sure if a maker does that, you'll never sell his cues.

I don't know anyone who got caught making Gina anniversary cues, using a Gina logo so you got me there. But it does sound interesting.

Short version.
1. My concern expressed before start of project.
2. Went by "personnal use" gray area being a 1 of 1
3. Laws without borders, craft with no bounderies!
4. My deficiency and I apologise
5. Proper entities will be happily addressed
6. Friends comment with knowledge that I strive to be on the up and up.
7. Proper entities will be happily addressed

You know, the thing is I would have no problem paying for the use of the photos. If, when I'm in Peoria and show each of them the cue and ask for their autograph on the certificate, they ask for compensation I have no problem with that, assuming that it's within reason. Again, I had no idea that picking those photos would cause such a stink.

I guess I'll just have to keep it locked up in a safe and never show it to anyone...lol.

And what I "somewhat" see through my visor. It's quite unfortunate that I can't get this new camera to do clear close-ups. My older one was better but I busted it a while back. I thought this higher pixel designation means it's better, I was wrong. So I just shot through my magnifying visor but the detail still lacks all the gradient shades!

To answer too a question posted in another forum:
1. Yes I do the scrimshaw.
2. No, I don't have an overhead projector to project the image onto the piece. It's done freehand with a motorized engraving tool that I made then detailed with self-ground profile 1mm drill rods.

Don't sweat it RZ. You have a beautiful cue coming from a master cuemaker. The only people who could possibly take umbrage are the ladies on the cue. If they don't have an issue then who gives a crap what anyone else says.

I agree 100%! This is art at the purist level IMHO! I feel if the subjects did take issue, it would be in poor taste on their part! They are being imortalized on this cue by a true artist. If these were to be "mass produced", for commercial purposes, the situation would be a lot different, but Edwin has too much class for that! A one of a kind piece of art like this should do nothing but honor the ladies who's images adorn the cue! I'm sure you'll treasure this cue for the rest of your life and rightfully so! It'll surely be a masterpiece of epic proportion! Edwin is "the man" IMHO, at this type of art!

Talking about photos in general, if one uses part of the photo --- can that be a basis for infringement? I have the impression that it must be the whole photo for it to be violative. Maybe Bruce and the others who have more insight into this can shed light on this matter. ;)

I say WOW, that is very nice work. As a bit of a toolbuilder I am also impressed with the handbuilt engraver... 1mm, wow again ! These cues, and others adorned with your beautiful scrimshaw work are sure to be treasures, thanks for sharing.

When Andy Warhol made that famous picture of Marylin Monroe, did he ask Marylin for a signed release, or get permission from the photographer who took that picture which he used as a reference?
