Lets say you sent a couple cues in on a trade, the deal fell through, and you had your cues sent back, when you recieve them, you find one cue had been damaged, and the person openly admitted taking the cues or cue to the hall, while they were in this person's possesion..

Also, lets say I have filed a damage report to the company used to ship the cues, If they grant a damage refund all is ok, but if they find they werent at fault would the person who sent the cues be responsible for the damage?


How would you handle this if it happened?

Was the box damaged? What kind of damage are we talking here. If it is something that occured while at the pool hall I would say the guy should pay to fix it.
 
yea the guy who had them then sent them back would be at fault. and u shouldnt be the one to file the claim anyways since he sent it back to you. even though your deal fell through, if he shipped it to you he is responsible for it...thats what insurance is for. either way, if it comes back to you damaged then he should offer some sort of a fix.

Bad enough it would be detrimental to the value. all cosmetic, the ferrule is damaged too.. I could get it cut down, but it would be quite a bit to get the place out of it. I couldnt repair the rest unless it was refinished. one spot the clear is gone and the wood exposed.. the other is quite a big dent....

The box wasnt really banged up or anything, and was the same box I had sent them... bubble wraped and all.

Im not sure how the Shipping company would handle this being a custom cue..having paid 75$ to get my property back, (overnight) then this, is hard to swallow, and I need advice.

if he messed up a cue that badly dont send him his stuff back yet. if u already did then ask him to fix the situation. if that doesnt work post his name. thats pretty much all u can do right now unless the shipping company reimburses u for the damage. but i doubt they'll give u anything if they see that the package it was in is completely unharmed
 
Injured Cue

Don't file a claim unless it was damaged in route from him to you since you would be comitting fraud. Since the package was bubble wrapped and the bubble wrap wasn't mentioned damaged you need to have the person who damaged your cue pay for the repair.

the person who sent it denies there was any damage before shipment...Flat out, said no damage....So I shouldnt believe this person?

No damage to bubble wrap, as far as I could see, the Box wasnt banged up, but my cue sure was...

I'll try to get ahold of Dave Albrecht, and see how much he would charge to repair my cue, as some may know I just recently purchased this cue from him..

Is it the cork wrap cue you got?,what a pity,nice cue,im suprised you wouldve traded after you raved about it.
 
Do you have evidence of the cues condition prior to you shipping the cues to the other party; in addition do you have photos to document the damage that occurred some time post shipment of the cues on the others part? How do you know the cues weren't damaged in transit from you to the sender? Further, considering previous threads on the matter, does the accuser have a MO to make the cues appear damaged post delivery? A little photoshop here and there, and all the sudden a ferrule's cracked... a nick in the finish, etc...

How can you prove your cues weren't so limp prior to your original shipment to sender, that you had to use viagra instead of chalk just to get something in a hole(on a Valley barbox?)

There's a lot of variables and "what ifs" here. I'd probably just cough up for the repairs and shut up about the matter. Not that I'd be happy about it, but you can't get everything you want. JMHO.

Yes I got caught up in one of them thar "good deals" Im just thankful to have the Albrecht back in my hands, although banged up, she is with me.

No hey bro I never recieved anything from this guy, nothing! well my cues back, all this did was cost me money, I paid for the shipping both ways, now im having to deal with damaged goods...:mad: ...............:o ............:) MERRY CHRISTMAS!
