This is a Civil matter where the case is decided on a preponderance of the evidence, every state has different laws governing these kinds of cases and how much you can sue for, the problem is going to be if there is not a meeting of the minds because of the "cancelled order" , I assume no written contract? After the completion of the cue and they will sell it and you will get all your money back. Unless its some horrible design cue that someone thought was nice to have them make. Special customs are restricted from 100% refund.

2. Pay the balance for the cue when completed.”

Yeah, that’s probably the desired outcome. There’s been dozens of new Cohens sold just here on Az during these 6 years since I paid for mine.Surely if the cue is "almost done" he can provide a guarantee for when you'd have the cue in hand.
I suppose at this point his preference is probably that you cancel your order and he pockets your deposit AND sells the cue.
