When to draw the line with cue maker?

Ok, talked to the guy now, he say he owes me nothing since in his way of thinking I "cancelled" the order when I asked him if I due to financial difficulties could sell my spot in the production queue. I contacted him later on and told him I never got around to doing that and I'm ready to proceed. (this was January 2020).

My cue is "almost done" now and I can either pay the rest or forfeit the deposit.

So, I sent a well known cue maker 900 bucks May 15 2018, was told to expect 16 months delivery time. I'm checking in every 6 months and there's always a "reason" for delay. Even though I am fully aware that the deposit is final and not refundable, wouldn't y'all agree that it would be the right thing to do to pay me back my deposit when it's been 6 years? I don't even play anymore. :-(
Just file a small claims case and get your money back.

And even that's a long-shot.
Im undefeated....guy won't show anyway because it is indefensible.

Without a contract in writing he is not winning.

The company I am planning to have a cue made asks for a deposit and 100% refundable and any payments made along the way.

After the completion of the cue and they will sell it and you will get all your money back. Unless its some horrible design cue that someone thought was nice to have them make. Special customs are restricted from 100% refund.

That is pretty fair to me.

This is a Civil matter where the case is decided on a preponderance of the evidence, every state has different laws governing these kinds of cases and how much you can sue for, the problem is going to be if there is not a meeting of the minds because of the "cancelled order" , I assume no written contract? Good luck and I hope you get a good outcome.

Sounds like a good way to do it.

I suggested to Cohen he sell the cue to one of his dealers and refund my deposit. (I’ve already got a few PM’s informing me that he seems to prioritise the dealers before the individual customers anyway)

It’s been 6 years. I even stopped playing. :-(

Sure I could get the cue, if he ever completes it. It’s been “almost done” for a year now, but it seems insane to ship it to Sweden and then sell it back to the US where 99% of the market is.
 
depends on the state, in NY a verbal contract is just as binding as a written contract in small claims court.

I'm not saying it's good just saying what the law is NY, I hope he gets something

Surely if the cue is "almost done" he can provide a guarantee for when you'd have the cue in hand.

I suppose at this point his preference is probably that you cancel your order and he pockets your deposit AND sells the cue.

Yeah, that’s probably the desired outcome. There’s been dozens of new Cohens sold just here on Az during these 6 years since I paid for mine.

That's the one option he's not offering. :)

He's confident my hands are tied since we're not even on the same continent.
Well, at least I know one cue maker I'm not gonna recommend going forward, a bit sad, I read so many positives about Cohen.
