Harassment - your view please!

It was stated as a means of pointing out that he has a good reputation on these forums and in the pool world. He's got a lot of character witnesses in the pool world. :)



I made no mention of how he is currently acting and will not make a decision based on one side of the story. What I did say, and apparently didn't use enough verbiage for some to understand is that (outside of this current situation, which I will not comment on) Jake is a very nice, personable, honest, person. In his everyday life, he is well liked, well versed and plays well with others.

The closest I'll come to even speculating on his actions about this situation is this - When it comes to your survival, (livelihood) are you going to go fight to survive or roll over and play dead? It is human nature to fight tooth & nail for survival (survival of the fittest). Some people are just mean & ruthless and would do cruel, hurtful things on purpose because they get a kick out of that. That is not Jake's nature. Many people have fought tooth & nail for no reason (they were given incorrect info, or misunderstood something). It's very possible that Jake honest to goodness thinks (thought) he was within legal rights to do what he has done.

Both seem to be claiming they have legal rights to back their actions. One is wrong but can you blame them for fighting tooth & nail to fight for what they believe is right?

My "biased post" was to simply let Angela know that while she isn't having a pleasant experience with Jake, he isn't the mean, horrible guy she thinks he is. Instead of wasting tax dollars going after someone who is actually a nice guy (when he's not fighting for survival), this is something that could be settled peacefully because with someone like Jake, that is a possibility.

If jake were one of those jerks that would do cruel things to people just for fun because they get a kick out it, I would've said so.


Keyword highlighted & should be sufficient for explaining why Jake didn't talk to him about this matter.


Last but not least, after having read every post in this thread, I've got to say that Angela you are a major part of the problem. The fact that you knew of Jakes website and absolutely refuse to change the name shows that you are very much a part of the problem. Had you acted more maturely and put yourself in Jake's shoes to try to see his point of view, you would've simply used a different domain name (if you were a nice person). Instead of you're acting indignant as if you've just drawn a line in the sand and stood there with your arms crossed saying "I dare you", simply because you can.

I didn't start this... I simply chose a fair name for MY website. I'm using it and have spend $$$ as well as much time getting my name out there. Jake has contacted my suppliers to get my property taken down. These are images I OWN. I created... If he has a problem - I encourage him to hire an attorney and sue me... I have not infringed on his name or logo.

Room - When put with the above word - where we play
Tees - T-Shirts what our designs are on

What I do care about is you coming on here and crying foul because someone defended themselves when you blatantly chose a domain name that is visually & verbally similar to the one that person has already established.

I repeat, a nice, respectful person would've understood where Jake is coming from & changed their domain name (or better yet, never even made it). You could easily do that, but you won't. You're the "cruel" personality type of person I mentioned in an earlier post. You're doing this because you can and you have zero disregard for the years, hours, and money Jake has put into his domain name. :rolleyes:

Well said. Angela, on your video you say you are no drama queen, but that is exactly how you have acted on this forum today. FWIW, I agree with Urackm. You knowingly and willingly took a name that was VERY close to Jake's existing one and shouldn't be surprised he is defending his business. Act as professionally as he has and hire a lawyer. Stop taking it so personally and treat this as a business issue, NOT a harassment issue...imo...VIOLA!

LOL this is getting a bit carried away. Kinda reminds me of an old chat site I use to go to... when people would get pvt msgs they would cry harassment.. I GOT YOUR IP & AM CALLING THE POLICE! Personally I thought both sites looked good... don't see why they can't work it out without the threats of lawyers and lawsuits. I don't know either of these people but when you are new in any industry and enter into business in this manner you won't last long.

I do have a question of my own though. Just because a lawyer is a friend of someone does that give them the right to call up anyone they choose ? I would think the individual would need to be represented by documentation. This I wouldn't know as I am not a sue happy person.

As the thread has grown taller and grown hair, Angela, IMO you have lost a lot of reputation. You could have stated your case (one you own, imo), and not gone "FBI Gone Wild Over Horrific Harrassment Case".

It's not too late to do something morally decent in this crap-fest.

For now, you lost any chance at my business.
 
from the looks of this both of you probably dont make all that much money off of either site. thats why you are here. the cost of defending your logos in court would break you.
so instead of raising the level of hatred, maybe just call each other and work out a settlement. neither will be happy. maybe one pays the other to change the sites name, or leaves the tee business. other wise both will lose and suffer for no real reason.
this is a civil matter and court costs will eat up any profit you will turn for years.

Eric Yow definitely wants no part of this crapfest. For one, I highly doubt Angela retained him. Two, I'm not sure he is admitted in either state's Bar that the businesses are located in.

I wish I could take back most of my posts on this thread. This just got out of hand and like most of you, I found myself glued to it all day. I felt a need to respond somehow to defend myself when I should have left it alone. I apologize
