I admitted I researched trademark law to be sure the words I was putting together would be safe from copyright and even searched them for trademark. It wasn't until after I had my website up and running that I found the other painting website, not including the word room. The name PoolRoomPaintings came natural - not to mistake it with Swimming... LOL but serious!

In an earlier post, you stated that you knew about PoolPaintings.com before purchasing your own PoolRoomPaintings domain. I tried to find it, but saw you altered the post #34.

She admits to knowing that PoolTees.com already existed, as well. She is blatantly trying to ride on their already established businesses. People who wouldn't know better would most likely confuse them and think they are at Jake or Arthur's website to buy their pool-related apparel or art.

I'm assuming you've never in your lifetime happen to get your words mixed up.
It's also irrelevant to the original post. The issue at hand is whether it was appropriate for PoolTees to go to Facebook and MySpace and have PoolRoomTees's stuff taken down via alleging infringement when it's clear that their trademark application was rejected by the gubmint.

The issue you're mentioning is a separate question- whether PoolRoomTees intended to leech off of pre-existing sites because their names are similar. I have no problem with this question, but please don't link it to the Harassment thread because this issue is a completely seperate thing.

Ok, I changed the post because I feel there are a lot of Pool and Billiard websites out there that I didn't want to infringe on. Yes, including Arthur Robin's.

Description in a name... My history and opinion only!

I once own a business and the name was "The Cozy Cottage" and even though we had over 7,000 sf of Antiques and consignment items, because the name of my business didn't actually describe what my business did - I believe I lost potential customers.

Now if I would have simply named the business Antiques and Consignments, everyone would have know what I was all about - I couldn't have trademarked this name either..

It's not a case of her getting her words mixed up. She went out of her way to alter her original post so she could lie and say she had never heard of Arthur's website before purchasing her domain. I only linked to the other thread so people can see the posts for themselves. It is a different from the topic she originally started, thus the new thread.

No. It NOW reads "It wasn't until after I had my website up and running that I found the other painting website, not including the word room", meaning you are now saying you didn't know about Arthur's website when you bought your domain.
 
So by using the name "pool room tees" instead of "pool tees" shes guilty of copyright or riding on the coat tails of another company.....?????????
Some people really have too much and nothing to do!

Marissa - I am very confused. From your post in the original thread (and not sure why you thought the need to start another thread), you posted the following:

A) The logos are different, except that both have pool balls as the "o", something LOTS of people do in the industry. Except one uses two eight balls, and the other uses a nine ball and an eight ball.

B) Your shirt designs look nothing alike.

I also just want to say... this site has a history of boycotting vendors and even cuemakers who make trouble. I would hate to see that happen to either of you, as both obviously love to bring positive attention to pool and billiards.

Seems to me that you had no issue with either site. Now you do? Did you get a free T-shirt from Jake?

I have said all along that this woman and her new website is wrong and she knows it. She feels guilty about it - that is why she came on here, that is why she posted a stupid YouTube video about it, that is why she is trying to counter sue based on harassment. Leave the courts out of it except to defend yourself for trademark infringement. The courts have better things to do than hear any more b.s. cases such as your accusations of harassment that are, at best, a stretch.

Then it was revealed that she stole one of her shirt designs, and I noticed she was using another brand's copyrighted name on another. That makes her a liar and a thief.

Where do you see name-calling? Because I said she is a liar and a thief? Well she lied repeatedly; therefore she's a liar. One of her designs is stolen from another tee shirt company and another designer bears the name of a copyrighted brand; that's theft. That isn't name calling. It's calling it like it is.

She came on here asking for everyone to get involved, crying harassment (which was not the case), and making threats with bringing in the FBI.
