Anyone that posted t-shirt ideas in adchalk's "seemingly innocent" question that made no mention that they were in fact looking for ideas that they could put on shirts and then sell? I'll leave you with this:

Also ironic is that on her website - adchalk is right up at the top for a related pool site and she lists many sites and forums but no mention of AZBilliards.Com while she feels the 'right' to come on here and freely advertise under two different sign ons.

Okay, you found a contradiction. That must prove everything.
I'm assuming you've never in your lifetime happen to get your words mixed up.
It's also irrelevant to the original post. The issue at hand is whether it was appropriate for PoolTees to go to Facebook and MySpace and have PoolRoomTees's stuff taken down via alleging infringement when it's clear that their trademark application was rejected by the gubmint.

The issue you're mentioning is a separate question- whether PoolRoomTees intended to leech off of pre-existing sites because their names are similar. I have no problem with this question, but please don't link it to the Harassment thread because this issue is a completely seperate thing.

PoolTees can allege infringement but it's up to the paltform provider, Ebay, Facebook, MySpace, etc... to take the action of removing content that it feels is infringing. If they do it or not doesn't mean that the person making the allegations are right or wrong it just means that the platform provider feels warranted in making the decision they did.

I would tend to think that FB and MySpace aren't stupid and take this stuff seriously. I am sure that they have a process to review these type of claims and I am equally sure that they get these claims all the time. Their lawyers or WHOEVER is on their payroll PROBABLY has more experience in trademark law than any of us do. They also have an obligation to themselves to cover their own ass and not be hit with a restraint of trade lawsuit.

So maybe, just maybe, someone smarter than us sees some chance of confusion by the fact that there are two businesses with substantially similar names selling the same products.

Ok, I changed the post because I feel there are a lot of Pool and Billiard websites out there that I didn't want to infringe on. Yes, including Arthur Robin's.

Description in a name... My history and opinion only!

I once own a business and the name was "The Cozy Cottage" and even though we had over 7,000 sf of Antiques and consignment items, because the name of my business didn't actually describe what my business did - I believe I lost potential customers.

Now if I would have simply named the business Antiques and Consignments, everyone would have know what I was all about - I couldn't have trademarked this name either..


Try this JUST LIKE EVERYONE ELSE IN THE WORLD DOES - The Cozy Cottage - Antiques and Consignment Items.

Do you need a lesson in sign making now too?

If you did your job right then "The Cozy Cottage" would have become "the place" to visit for whatever it is you sell.

No worries, everyone knows what you are all about.
