On 3/26 I brokedown and moved a table in a 2 millon dollar home to the attic as requested by a realator/property manager so the room could be re-carpeted. I said ok who do I bill for it, she said bill me but I am not paying for it , I said uhhhhm... she then assured me I would be paid by the end of the week.

No payment yet and she did not respond to my last email. I have sent 1 at the end of each week (3 so far). I am holding off on throwing a cue ball thru her front window for now :killingme: , has anyone else been screwed for payment and what did you do about it. Thanks for any help

File a lien against the estate, can't sell without you getting paid!
 
Your next email should contain the following.

On 3/26 work at ---- was performed satisfactorily with no payment received. As of today 4/26 we have still not received payment. In accordance with Va. law we will file a Mechanics lien against said property in the next ten days. Hopefully this matter can be resolved quickly.


I do not know all of the laws in your area but this usually works every time!

Thanks for the replies. I recieved an email from her saying did you send mr and mrs x a bill in Alexandria? I replied how could I when I just learned thier name from you just now?

So when I get home this afternoon and after the mail runs I will call the owners, my question now is who actually owes me the money and if not paid who do I sign the lien against?
 
Thus the importance of getting a signed work order before doing any work to prove what is agreed to be done and for what price.

In this case the realtor/property manager acted as an agent for the home owner and authorized the work and stated to send them the bill. While they are not actually paying for the work (the homeowner is) they have the responsibility to get you paid since they authorized the work.

I agree with Scruffy but I'd go to this realtors office (face to face is much better then phones or email) with a bill and demand payment. Get loud if you have to but let them know that you either get a check today or you'll file a mechanics lien against the property. It's not your responsibility to chase down payment from the homeowner unless you agreed to this before doing the work.

As I remember in TN, liens were filed at the county registrar of deeds. That's who I'd suggest you call in your area if it goes that far. Not only for the amount of the job but also the cost of your time and effort to get payment.

Just called the homeowner , she seemed very upset about it, told me the tennant was supposed to pay for it not her, she said she was going to take it out of thier security deposit and that she would mail me a check today and thanked me for doing it for them.
 
For future reference, I don't believe a mechanic's lien can be filed for work that was performed on anything that's not part of the physical property.

Replacing carpet is part of the physical property and considered an improvement. Bob would be entitled to compensation for labor as he was contracted to remove the table so the recarpeting could be done.
