    OP had mentioned pocketing the 9 "legally" which leads me to believe it must be a called shot. And, it may still have to be spotted depending on tournament rules.

    In situation one, the breaker retains control. 9ball is spotted and breaker may shot or push. Second is different. If the TD has set a rule for calling the 9ball, pocketing the 9 without calling it is a foul; therefore, the ball is spotted and the opponent has bih.

    I do not remember ever seeing this at pro level, but if shooter touches the ball (any ball), inning is over. A pushout, however, requires legal tip contact.
