Well the FTC has admitted that they cannot and willnot infringe on Kevin Trudeau's First Ammendment rights to free speech. What Kevin Trudeau is doing is screwing the federal government that screwed him. There are literally hundreds of products offered for sale on TV and the INternet that cannot and do not live up to the claims made. You don't see the FTC banning them.
KT has every right to express his opinions through a book. Just as some Nazi idiot has a right to espouse his twisted beliefs. Yes, a book is a product but it is not and cannot be included in the FTC's ban on advertising. Why doesn't the FTC ban Pat Robertson or Benny Hinn? There is no scientific evidence that Jesus saves, heals or otherwise has any real effect on someone's life. Yet that doens't stop these charlatans from claiming that a belief in their God is all one needs to survive, along with sizable and regular donations to their organizations.
The only way that someone's first ammendment rights can be curtailed is when they incite violence. In that case they are asking others to infringe on the consititutional rights of others and this is the only thing the Supreme Court has found to be a reason to stop someone from speaking out. Otherwise each of us is free to to speak our minds about any subject we wish to. If I trample on someone else's reputation then I can be sued by that person for defamation or libel but that is a civil matter between legal persons.
Kevin is well within his rights and is excercising them.
