Apparently he wants to bring this back up so im going to tell the whole story before he lies to everyone.

He wanted my gold crown, He told me that someone just passed away a week ago on the phone. We agreed on a $800 deposit. He was supposed to mail it overnight after he notified me that he didnt send it out the past few days. I sat at my house all day saturday only to call him and have him say on monday that he sent it overnight on monday..so tueday i was supposed to get the deposit and go straight to kentucky from florida. the deposit arrived and was only $400. We talked and i said that it was ok since i already had the table apart and 2 people said that they would take off work for a day if i paid them $150 to come with me. I put a deposit on a moving trailor of $60 something.

He calls me at 11 at night saying that he just watched his fiance's parent take their last breath and that the funeral is more expensive than they thought and he couldnt buy the table..I told him that i had 2 workers already take off work and guaranteed them a days pay and put the deposit down.

He didnt call and went straight to the boards saying that im scum and i should do what is "right in my heart" and bashed me before i even said that i wouldnt give him his deposit back. at this time i told him that i wont lose money out of my pocket because he didnt have the money for the table to begin with..SERIOUSLY this is what he said "I lost my backer". he was getting the money from his fiance. He is 50 years old. he shouldnt need a backer and shouldnt spend money that he does not posess.

How can he just have watched them take their last breath when a week ago he told me they died a week ago. thats 2 weeks. I am sure that club billiards sold him a table instead. I know they pm'd an offer. who knows.

SOME OTHER FISHY STUFF> The day before he cancelled he asked me if i would like some of his cues in trade for the table. I said no. Now that his "backer" fell through. I offered him to pay partial for the table and sell a cue for the rest. He all of a sudden didnt want to do this now. He didnt want to take out a small loan for the rest of it. He didnt want to make payments to me. How much more can i offer him to try and make this deal right so noone loses anything.

Now im left with a table taken apart and some guy lieing and wanting me to pay for the expenses out of my pocket because he fell through 10 hours before we were supposed to leave. Now he is threatening to sue me without responding to my message of how i had to spend it on non refundable expenses. and get this "TELL MY PARENTS". I am a 26 yr old army vet (i only did 6 years) i know its not really a vet but its better than most. And threatening me to bash me on AZ. SOMEONE BACK ME UP.

From what i read, doesnt look like you did anything wrong here.
Thats what a deposit is for, to use to pay your expenses when the buyer backs out.

Oh and as long as you completed your initial term in the Service, and ended it with an Honorable Discharge, then youre considered a Vet.

i was going to do a nice gesture and see him at the dcc and give him what i could. hopefully it all. now that he is trying to bash and sue me i will be glad to bring all my emails and receipts and the people i paid that took their time off to court. It is 170 bucks to press charges on someone. Its not worth the time and money but if he wants to do it this way then so be it...Im not rich and im not paying for his lies and mistakes. be a responsable adult and dont put a deposit on something that you cant afford. Now im left with a dissassembled table and its hard to sell a table like that. If there was some way of making this good i would but is seems like he chooses not to meet in the middle. i gave him all the options in the world. if he wants the table he can pay the rest of the money by the end of the week and pick it up at his convienence also....I think a gold crown delivered for $2200 was a good deal..its a shame he has to put me in this position and try and ruin az for me. and make me sceptical of dealing with people on here. if someone has a legitamate way of solving this please respond.

thats what i tried to explain to him but if he can see that other people agree with me and that he is in the wrong i may be able to not have to go to court and stuff. If i do i will be pressing charges for the cost to reset up the pool table and the time that i took off work personally. I dont think i will be rewarded for the time off work though..

I sold 8andoutagain a Instroke Buffalo case He sent payment fast and I mailed it out the day I got the money Real Smooth transaction!I think you loose your deposit if you do go through with the deal even if you spent nothing and never took it apart.Hope all works out ok for both of you!

Wow! That Sucks! Shouldnt He Realize Most Deposits Are Non Refundable When The Buyer Backs Out Anyway!!!feel Sorry For The Loss Of His Family Member , But A Deal Is A Deal And A Deposit Is A Deposit!!
 
I doubt you will get set up fees or lost money for going to court however you will get the deposit! I'm not a lawyer but I have used a few! I once put a deposit on a house changed my mind talked to a good lawyer he said I lost the deposit unless something was not as stated. Good luck Ron

I do remember when you posted concerning that someone had backed out on the deal, leaving you 'holding the bag' with regards to expenses, and that you were willing to cut someone else a deal, since the expenses had already been paid.

I might suggest, just in case you need it, that you contact a freight company and get quotes for not only the shipping costs from Orlando to his address in Kentucky, but also make sure that you get crating charges included as well. This is what he would have had to realistically expect to pay, had he purchased this table and had needed to have it crated and shipped to him. Additionally, if you had agreed to also set-up the table for him as well, get a quote from a table mechanic, to show those charges as well.

I would also get the documentation from U-Haul showing the charges for the rental, as well as the deposit that you were forced to forfeit as the result of canceling less than 24 hours in advance. I would also get affidavits from those whom you had hired to assist you. Also, keep any and all correspondence with regards to this transaction.

I say all of this because, should he actually attempt to take it to court, you will have a 'paper trail', and I can tell you that judges LOVE 'paper trails'. He will not have much in the way of a leg to stand on.

I will say that, in the future, you may wish to not incur any expenses without having the agreed upon monies in hand. From what you have stated, my accounting is $150 ea for the workers and an additional $60 for the non-refundable deposit on the rental. That already eats up a bulk of the monies sent to you....if you feel obligated to refund him anything, it would be but the $40 remaining out of the $400 sent.

Explain to him that had he not given 24 hours notice on canceling a doctor's or dentist's appointment, he would have been charged regardless. This really isn't all that much different.

I would like to add that if in fact BilliardsClub did send him a quote AFTER he had already agreed upon the deal with you, I would be sending a nice little note to Mike or Dave. So not cool to be cutting into someone else's action. I have no use for people or dealers who operate in this manner.

I think you are a victim of a bad poker player. I think he is bluffing an if it were taken to court he would only be out more money. I live in Kentucky an when you give a deposit an don't fulfill your end of agreement your deposit is gone Bye Bye. I don't believe you will hear anymore from other party. This is why I get the big bucks$$$$$$.

thanks guys, i agreed to send him the rest of the deposit that was left after expenses and havent heard back for almost a month untill this today. i did keep all emails incase this happened and i can get phone records stating when he called. i can easily get the 2 people i agreed to pay to come to court with me also...im not trying to make the guy out to look bad but i wanted to post the truth before he did what he did last time on here and start a thread assuming that im childish and tried to play the sympathy card. if i could get the table sold i would gladly send him the money back. im not greedy. this has been a big hassle. my main focus was to have a few more opinions for him to see and just take it for what it is. I got minimally screwed and im not taking the financial burn also. he probably has another table from club billiards and got a good deal on it anyways. just pretend it was 400 more than what was paid and you probably still got a steal. expecially if he got one of there diamonds for 2500.

as far as freight goes it was super expensive. thats why i calculated the cost of the rental and gas before hand for him. i should have never done anything untill the agreed deposit was sent. how would he feel if he sent 800 and i sent 400 back. probably not that mad. but he doesnt want to see that either..now i cant even play on my own damn table too....

Well at least you got a deposit. Even if it is half what was agreed upon. And I be damned if I'd give it back to him.
 
If he agreed to an $800 deposit and only sent $400, he's already tried to pull a fast one.

If he doesn't understand the concept of a "deposit" then it's time he learned that lesson. The only time a deposit should be returned is if YOU backed out on HIM, not the other way around.
