Following the decision of November 27th 2008, after careful consideration of the WADA rules and taking all arguments and all relevant circumstances into account, the Hearing Panel of the UMB came to the following decision:
1. Following the WADA rules and the facts occurred during the World Championship Three Cushion in St. Wendel, player Peter De Backer has been informed about the automatic suspension for a period of two years.
2. The Hearing Panel has taken a number of arguments into consideration as well as all circumstances involved in this matter:
1. Personal emotional circumstances;
2. The way the prohibited substance entered the body;
3. The insignificant amount of the found prohibited substance having no influence upon the enhancement of the sport performance;
4. A first WADA rule violence;
5. The responsibility of the athlete to have taken the substance;
6. Conviction of no intention to enhance the sport performance;
3. The Hearing Panel decided to the following sanction:
1. Reduction of the suspension from two years to a period of two months ending on December 15th 2008;
2. Restitution of the prize money, ranking points and bronze medal obtained during the World Championship Three Cushion 2008 in St. Wendel;
3. Restitution of the ranking points and eventual prize money obtained during the World Cup Three Cushion of Hurghada 2008;
4. Registration of this occurrence as a first violation of the WADA rules.
The Hearing Panel thanks player De Backer for his cooperation during the investigation procedure and express the hope that this case will remain a first and sole violation.
The Hearing Panel remains that UMB is obliged and will respect the WADA rules and sanction all violations of these rules accordingly in the benefit of all Athletes and of our Sport
