Diamond tables add in top banner

I'd read the fine print on the acceptance agreement, the doc you signed to say "yep, I'm happy with the product & install". Just saying...
 
I looked this up and you are correct. But to bring an infringement case it must be registered to make a public record of its ownership. The ability to make infring. case requires this registration. More:https://www.copyright.gov/engage/photographers/
Yes you must register for a legal proceeding. Just to be clear in case some may not understand, it does not have be registered prior to someone using it. The copyright is in effect at the time the photo was taken.
 
Hey guys, all this talk about copyright and what is and what isn't is meaningless. As far as this post is concerned, I know copyright extremely well, it was my job to know copyright.
I probably should never have posted this, but thought it was a little funny, I guess that was my fault. As usual on this forum these posts seem to always get off tract a little.

Step 1: screenshot every page of their website with the photo, adding a big red arrow pointing to it on each, and take a screenshot of your local exif data of the original. Extra credit: view the source code of each webpage and make a note of your image file name on their end. Include the full url to the image in your email (below).

Step 2: write an email with those images attached to tell them you’re flattered that they’re using your copyrighted photo but don’t recall permission being granted for their use by you or through any of your agents, and ask nicely for one of their 16 ball cleaners (or something of similar low-4 digit value to you), in consideration for full irrevocable rights, mentioning that you’re a pro commercial photographer and you really don’t want to have to run the issue by your counsel, since it’s your home table and you really love their products.

50/50 chance that is successful imo, and shouldn’t burn any bridges.

There’s also a 50/50 chance they’ve already seen this thread and will be changing the image soon, while crossing their fingers they don’t hear from you or an attorney.

If/when they see this thread, they’d be smart to post here with a mea culpa and promise to make it right. Hey, mistakes happen, it was probably an intern or web dev shop who found and inserted the pic and nobody upstairs questioned it. The damage to their reputation could be far more expensive than their cost on a ball cleaner or whatever.

Musky, dont know why i had that mounted, would only do replicas now, and only 51" or better. Now I only fish for salmon and walleye, but do go out for musky at times with my son.
We were out musky casting a little over a month ago and caught this northern. Thats about as big as it gets for Wis. A little over 47"

I'd bet they didn't get permission from anyone. Their brand new site has video of professional matches, and still pictures. It is what it is.

The site redesign is nice in general. Someone missed the mark completely on the Smart Table page. Nowhere does it even say that it's a coin operated table with a regular CB, which is its main and unique feature.

I also see they have teamed up with Manning and when you go to the "store" it takes you to his page, which makes it seem like it's Diamond directly but it's not. His page also has Diamond Tables in the URL.
 
I think Diamonds new site is nicely done, and just because they borrowed my photo, don't assume they did the same to others.
Also while I can't tell the make of the table in their main headline, I would assume the players are playing on diamond tables or what would be the point. That means they are a sponsor of the event and most certainly have the rights to do that. Also that is a public sporting event. Pretty much fair game anyways for use.
It does no good to constantly pick apart things.

Agreed. I think any business entity should ask permission first. It is the right thing to do and legally correct.
 
I guess I’m just built different lol I’d be like cool they are using my room for the web site ! I wouldn’t even think about copy rights or monetary value.
