Do you own this Leon Sly sneaky? (I think I got scammed)

First off, thank you in advance for reading the very long post in front of you. I was hoping you guys and gals might be able to help me with some light detective work.

I purchased this absolute beauty of a Leon Sly sneaky pete for a good price on March 5 off of eBay from a new seller with 0 feedback. (I'm well aware that purchasing from someone with 0 feedback was a gamble, so if you comment in this thread to tell me I'm an idiot for doing so - thanks in advance, you concerned upright citizen you.) He lifted the verbiage in the listing to the word from this thread:

His communication was pretty bad from the start. When I didn't receive shipping information by that Friday (the 7th), I messaged him and he said he'd ship it out that day or the next. I messaged him a few times after that asking for tracking information, at which point he said he'd talked to the post office and it would be there Wednesday or Thursday. Wednesday or Thursday I get an email with shipping information but it says the cue was already delivered on Monday. Since clearly the cue did not arrive, I talked to the shipping department at my company (I get stuff shipped to my place of work) who said they did not receive the cue. I called the post office and they told me the cue had been delivered already. When I asked the guy to look a little deeper, he said the photo they took of the label actually showed a different label and a different package - envelope, not parcel - and that this label actually went to a Burger King down the street.

Since eBay has the some of the worst customer service in the known universe, I was looking to ask for a couple of things - my first hope is that the owner of this cue is still on AZ and could come out of the woodwork so I know for sure whether or not I got scammed. If someone on AZ does own this cue, that means the guy who posted that listing clearly does not. The second thing is if anybody could tell me if they're familiar with this kind of scam, if it is in fact a scam, or if this sounds more like a flub by the post office.

Any help, insight, commentary at all would be appreciated!
 
Possible Scam

Someone posted about a scam like this about 2-3 week ago. I couldnt locate the thread but it went down like yours. How did you pay? If paypal, and you shipped for goods, you have some recourse with them. If with credit card, call them and see if they can help you out. Sorry for your troubles. More and more of this crap happening and it pisses me off.:angry:
 
I hope things work out for you, but it looks like getting a refund from Paypal or your credit card company would be your best course of action.

I just recently came across a very similar scam as was going to post on here as well.
Found a nice Tad cue on Ebay at a great price, and from the detailed description, it seemed like he really knew his cues. His low transaction count had me a little wary, though, so I googled the description and found that it was copied verbatim from a AZ Wanted/For Sale post from about 4 years ago. I asked him about it and also for new pictures and the Ebay posting suddenly disappeared. It looks like someone or several people could be using info from old AZ posts to make false listings.
 
If you used paypal they will more than likely make it right.

This is a prime example of why I will not ask anyone nor will I pay for anything and send the money as gift. I got burned on that once from a cue listed on here and that's all it took. Paypal told me first hand that their policy on refunds had changed just about the time I filed a claim. They did reimburse most of my money since it was sent in two parts but they said from then on any money sent as gift was out of the question. It's a wonder no one has started a thread specifically about that, or if they have I have not seen it.

The easiest way around it is price something with any fees included. Kind of like when you buy something from a retailer online, they don't say send us the money as a gift.

I'll probably try to open a case with PayPal or my credit card if eBay puts the kibosh on my claim. Do you guys know, if the seller doesn't surface or respond at all am I more likely to get my money back? Your responses have definitely helped to put me at ease a bit so thanks again.

With the fake label this actually puts the crime on a government level as he is using the post office to scam, mail fraud. You have a good chance of getting your money back and you should be able to file a federal case against the seller if you talk to the post office people about it.
 
You need to open a case with the credit card company you used to secure your PayPal payment. Not ebay, not paypal, the credit card co.
 
Was the address you had requested it ship to a PayPal 'verified' or 'confirmed' address? That may make a difference on the PayPal end.

I had a similar situation happen to me a year or two ago on a shaft except the seller had about 4 positive feedbacks. Turns out the same seller scammed about 4 people at the same time on cue and shaft sales, however I think we were all refunded due to the buyer protection policy.

Well that about settles it - definitely definitely definitely a scam. Thanks for letting me know about owning the cue Txstang1. I bet it's a hell of a player, ha.

I guess I'll wait to see if eBay can get my money back and let my credit card company know of the situation as well. To those of you who said my CC company should be the ones to deal with it, should I not wait for eBay to resolve it? Do they usually just do nothing in these situations? I have 24 transactions, 100% positive - this should probably do me some good against someone with no feedback right?
 
I would bypass ebay and notify your credit card company and they will work with you. Ebay won't be as much help as the credit card company will.

Thanks a ton to all of you for your advice. I opened a claim with my CC company last week explaining the issue and the money appeared in my balance this morning.
