Please stop busting Balls!
Its obvious it's not a ML. It's a $200 cue for christ sake. Let the guy pass on a deal to someone who only needs a $200 sp.
Really sick of all the forum K9 lately.

ToomnyQs, Good luck with your sale!

It's was an honest question. I did not mean to "bust his balls". Is the term "ultra joint" patented?

To bust balls though I will ask a follow up question; since this is only a $200 cue does that mean it does not have to follow patent laws if indeed the term "ultra joint" is patented?

Not being a forum cop but if I worked hard to create and develop a technology I would hope others wouldn't use my name to sell their product.

Cue is still available.. I would have edited the title but the system will not let us do that.. I apologize for my oversight.. It is a nice cue for under $200.. Just not a Lambros!

OOPs.. I just realized I bumped my listing too early.. Sorry for that.. I am not in the habit of breaking AZ rules, just copyright and patent stuff..

I thought I read similar to a ultra joint .... he never EVER stated that it was a ultra joint

To answer your question regarding patenting, patents pertain to structures and methods for the manipulation of structures. Patents do not pertain to names/terms. Therefore, any term by definition cannot be patented. Trademark law might protect the term, but in the absence of more facts, I don't know about this particular term set. After re-reading the post, the post also does not violate trademark law. It is settled law that the use of a trademark for comparison to another product does not violate trademark protection. Additionally, copyright doesn't apply for reasons I won't go into. The poster hasn't violated any IP laws pertaining to his original post.
