How long until i should escalate the PayPal dispute to a claim?

Has anyone had to escalate a PayPal dispute to a claim?

Here's my situation:

I recently bought a case that was listed as "98% new condition." When it came, it was very clearly not in the condition advertised. The material was breaking down and pieces of the interior padding had fallen out. None of the springs in the bottom of the tubes were functional, and some were just outright missing.

I've tried to contact the seller for 10 days now via private messages, e-mails, and an opened PayPal dispute, but gotten no response at all.

I'm trying to be patient, but 10 days seems like a long time to me to go without a response of any kind. Maybe the seller is fortunate enough that they can afford to take a 10 day vacation? I don't know.

Obviously, if the seller responds, the situation changes, but as it stands, how long would you folks wait before you escalate the dispute to a claim?

9 days ago!!! I think anyone who describes a item as 98%new condition and sends you a POS knows exactley what there doing and doesn't desirve the benifit of the doubt. I love when ever i buy a item from a very well educated cue dealer/seller and there's very noticible problems and when contacted they act like they never noticed it. Escalating it to a claim doesn't do any harm to him..it just gives him a reason to move his a$$ and correct the problem. As a seller I always respond to any concerns because there are those that demand perfection more than others and the customer is always right.

Well if it's a member on here than you can find out easily if you are being ignored by looking at their last activity. If it's ebay or something else then 2 weeks tops for me. I went through a transaction on ebay where my item wasn't shipped for 3 weeks after I paid for it. I was furious as I am very impatient when I want something. Needless to say I finally got my cue but the seller only contacted me 1 time to my 6. Good luck hope everything works out.
 
Yea I Think You Did Your Part To Try And Resolve It The Right Way!!!! Unfortunately For The Buyer If He Already Took Out The Money Of His Account It May Be A Looooooooooooooooong Time If And When You See Your Money Again! Paypal Isnt The Best Unfortuantly At Helping!
 
Did you pay with a Credit Card?

When the Charge shows up on you account, start the dispute with you Credit Card Company.
 
Don't count on paypal.. go the credit card route as has been stated. Paypal decided in my favor over a year ago and I've still only received $1.50 from them on a $35 decision.
 
Thanks for the responses. Good tip on checking the last activity. The seller is a member here, and it looks like their last activity was the same day as the case arrived to me 10 days ago. Does knowing that the last activity was so long ago change anyone's advice?

I guess I probably should have seen if anyone on here knew the seller personally and could tell me if they were on vacation before I posted this thread, but it's a little late to do that without calling out the name now.

I did pay with a credit card, so I can go through the credit card company if needed. I'd like to give them a chance to make the situation right, but at the same time, I'd like to get a refund and just move on.

Get on the phone, start your dispute, make copies of all e-mails, advertisement, etc. ;)
 
Holy Mackeral! Cuedoctor did you actually write - As a seller I always respond to any concerns because there are those that demand perfection more than others and the customer is always right.? Hats off to you! I thought that concept had gone the way of - the pushout on any shot.
 
As the fellas stated, get moving. I just went through this with some car parts off fleabay. Supposed to be new, but were VERY used.

Paypal sucks major ass! Firstly, the dispute took around 60 to settle, and in the end I won. But had to pay shipping back (which is major BS considering the fraud involved), and secondly, I had to trust this guy to replenish his PP funds to get my refund. The whole thing was a friggin joke!!!!

Their seller protection far outweighs their buyer protection. If I wanted to be an internet criminal, I would hide behind Pay'notmy'pal!
 
I would go ahead and file the claim

You only have 30 days from entering the dispute to file a claim so you might as well go ahead. I purchased a case 2 months ago on ebay and I hadnt recieved anything after 2 weeks, thats when I looked up seller info and tried contacting him, anter trying for a few days I did get an answer with excuses and apologies for no shipment and a promise get back to me and let me know what was goin on, after that I heard nothing for over a week and no answer on calls. I then filed my dispute (they never responded to it) I made it a claim a week later and amazingly my case shipped the next day.
I cant complain too much tho, the case had a frog jump cue in it that he added as a gift to make up for the problems.

Quite awhile ago I was going to file a dispute with paypal that never happened because it got resolved. So you might want to confirm if this is how it still works. With Paypal you have 45 days, if you file with your credit card company then you can't file a dispute with Paypal, that's according to Paypal.
At the time I didn't know what I've learned from azer's about the bs with Paypal. So I'd read all the fine print on ebay and paypal in regards to a dispute. So that way you've covered all the bases. and I'd go with the credit card company.

I will be BLUNT, your Credit Card Company has an interest in you as a Customer, Pal Pal could give a RATS about you personally. Forget Pay You Pal, and let the people you have a relationship help you their customer.
 
i have dealt with paypal since the begining of days! and truthfully they dont protect anyone but themselves!!!!!! the buyer as well as the seller is screwed most times if a claim is filed !!!!

heres a true happenin with me,,,,,,,,, had a guy buy a cue from me and pay and then say the box i sent him was empty! he filed a claim and i lost even though i had the tracking number! paypal sent my account negative and weanted me to put more money in it and i refused! they sent it to collections and over 8 months later the guys credit card was found to be fraudelent!!! the ymore than happily made my acount positive and said were sorry about the delay !! told them that was crap that they sent the credit collection people after me for no reason....... they told me not to worry they made a mistake and it happens!!!

fortunately it never hit my credit report but if it did id be a suing mamam!!!

paypal really sucks!!!

There's not much to make right if the item is not as described.
If you've exhausted your patience in trying to communicate with the seller then contact your cc issuer immediately and file a complaint - "Item not as described".

Trying to deal thru paypal only prolongs the problem. You'll get a pretty fast credit thru your cc issuer and it's up to paypal to deal with the seller. Ultimately you will need to return the item

I was contacted today by the seller, who was indeed on vacation. We're working on a resolution. For obvious reasons, I hesitate to say much more, but I'm pretty confident that we will reach a reasonable compromise for both of us.

Thanks everyone for your advice. I'll let you know how it turns out.
