Hypothetical 8 ball situation.

At that point, the breaker took stripes so the opponent is solid by default. Since no solids are left, he is free to shoot the 8 ball. I agree that after the break the rules may be unclear, but since a group has been taken, I think the 8 is fair game.
Yes I agree this appears to be the correct interpretation according to the rules as they are written.

What about another hypothetical situation where 6 solids go down on the break, the breaker calls the remaining solid, sinks it and scratches. Does the opponent have to take stripes? I think they do according to the rules as they are written.

Nah. The referees get paid the big bucks to make good decisions when the rules are lacking. Put them to work.
Yes and if, although unlikely, this happens in a major tournament then I guess the referee will discuss it with the tournament director/head referee, a precedent will be set and the rule will be re-written.

I think that's right. Probably a good time for a safety. Makes me think of a match between Appleton and maybe Orcullo. It was make it take it and after the break there were several clusters, so they were shooting each other's balls in t make the other break out the clusters.

In make it take it, if the breaker gets a ball down on the break and then misses his first called shot, does the incoming player have an option?
 
I’m glad I hardly ever play 8-ball…..if this ruling was made on me, I’m leaving the tournament.
Finding a way to penalize a great break is not admirable thinking.
Rules should favor excellence.

I have also refused to play in a ‘take what you make’ tournament…..I’ve seen Ronnie Wiseman make five low balls on the break…naturally this increases the chances of being hooked on the two remaining low balls…he ran out on high balls.
I love playing 8 ball (especially bartable) and I don't agree with "take what you make" either. I've played it enough and a real shitty scenario is making 2/3 balls of one group and nothing of the other. Make a great break, squat the rock and your immediately the heavy underdog in that rack.

Well, yes, except for the rule being rewritten if it's a CSI tournament since they already have a rule, And otherwise the rewriting may take a while.

Even when there is a rule for something as unlikely as this scenario, many refs/TDs will make up a rule since they often don't know all the rules. They are helped by the fact that no player has ever read the rules, and so has no grounds for contradicting the ad hoc ruling.
 
And here is the wording of the CSI rule which is in the section on establishing groups....

2. If all balls of either group are pocketed on the break or illegally pocketed before groups are established, either player may legally shoot the 8-ball during their inning. You win the game if you legally pocket the 8-ball on such a shot.

So what exactly was that "less than smart" protesters message??? He apparently isn't even smart enough to realize that he wouldn't be wearing clothes without that oil he so vehemently protests.
