Need help with a purchase I made on AZ

Is he a friend of yours or you know him and see him around. Ya know that "friend" moniker gets thrown around more in the pool world than in any other area.

I sure would like to hear the other side.

One thing I see on a lot of buyers end is the ole "because the seller said so" You could have asked for a video ahead of time, you could have not paid by gift, you could have also picked up the phone and called by now.

Now of course you are dealing with a road gambler so YMMV.

Where does $350 paid come into the picture? See the OP's post of what he paid ($235 shipped) here: http://forums.azbilliards.com/showpost.php?p=5431798&postcount=17

I think the OP was saying that if he had to have it refinished he would be in it for $350. How things turn into fact is pretty amusing.

Marc is a friend of mine, but I agree that this cue does not match the description - that is between you two. I have never had an issue with anything Marc has sold me or others that I am aware of, but his may be the exception. Marc is at DCC or on his way so I suggest you bring this up to him again when he returns.

Good luck to all.

Dave (still think $235 is a good price for a lomax j/b if function is what you are looking for, if I was looking for a j/b I may have bought it to put this to bed, but I am not)

I dont agree with that for anything but a last resort.
you are right: payPal has its rules. That can also work against the buyer.
Also, if he plays that card then the seller is unlikely to do anything for him... At least until PayPal issues a verdict.
At it is now, yheres a chance vidal makes it right.

Fair enough. Save it for trump. But I'd let the seller know how it's getting played out if they do not respond or are reluctant to make good. The seller knew what was being shipped.

I bought a Rich cue from eBay. The condition was described as good and clean. It looked like it sat on a wet basement floor for 10 years. Thankfully Ebay stood behind me.
If a seller does not disclose honestly I'd stay on them until everything gets straightened out....and quickly.

signed up. They are not going to change the rules for anyone that says it was a "mistake".

Understood...But I'd report the seller just to wake them up if the sale does not get resolved. Paypal will kick them out.

and why after a guy you feel screwed you and was dishonest, would you send the cue back and hope for a refund. at least keep it as you have something. only send it back if he sends the money first.

you might find yourself with no cue and no money.

pay the 100 bucks and get it refinished. and be happy that you only lost the cost of a refinish. then ask him to pay that and see what he says.

But how does a refinish repair the significant wobble in the shaft?

You know it seems to me that a lot of the time when sellers ship items to people these days they tend to ship the cheapest way despite how long it may take the buyer to receive it. In many cases that is via US Postal service. I have seen in a movie one time where the seller did that and later regretted it. The reason being they too did not advertise the item accurately and refused to stand behind the sale with a refund. The customer went to a lawyer and got a free consult then charged the seller with Mail Fraud. I am not sure if that is possible today but even if it is not it is a hell of a threat.

The seller should simply refund the money to the buyer and enclose a prepaid shipping label with the refund. When the payment clears with the buyer he should simply return the cue. It should never have gotten this far to go public and possibly ruin a mans reputation over a couple hundred dollars.

Hasn't Marc Vidal always been regarded as one of the "good guys in pool? It's not right for the buyer to handle your business like this. If he even responds to you at this point I'd be surprised. You know what's coming when you start this type of thread. Buy with paypal and a credit card...always.

What's coming when I start a thread like this? Do you not see Marc Vidal ripped me off! I bet you can't see anything wrong with this cue either and that its mint. Some people should keep there opinions to there selfs especially the ignorant ones. I started this thread because the seller will NOT respond to me after he sold me a piece of sh*t cue. At the DCC or not business needs to be handled here , I've already gave him a week he stated he was traveling last week as well. PM him 3x no response and I'm STILL giving him the opportunity to make it right.

You are the one who screwed up...use paypal with a credit card...

I get that. Trust me he screwed that up , I will never trust and gifted payment again. That being said PayPal gift ,money order, sent him a check, or any other payment method the issue now is that he needs to respond and settle the issue . It's not like the description is a little off , it's insulting sending me this cue. And to another person who posted its not a J/B and yes I paid $235 by the time I get a shaft that rolls straight that I was told would and refinish the butt end I could of bought a brand new one from Lomax himself.

My mistake in my reading of your original post, I thought it was a j/b, for that I apologize. Marc went on the road 2 weeks before DCC so he has not been in town and will not be until after the Derby is over.

Again, not getting in the middle about your issue, just letting you know that what Marc said about being on the road is true. But I would hope you would hold off doing anything rash until Marc returns home, especially contacting PayPal. :)

I wish you good luck in getting this resolved.

Dave

Come on Dave being on the road is no excuse..
Sending an email to the OP telling him all will be taken care of would take
2 minutes tops..
It's just a B.S. move hoping this thread loses traction over time...

Gee, if only there were some kind of small device one could carry around that would allow you to make and receive calls, send and receive texts, and maybe even do financial transactions like make refunds even when you are away from home and "on the road."

If only, if only.

MV was on AZB last on 1/19/16 @ 11:29pm.

The last message on his wall from 1/12/16 says to "empty his in basket " because it's full and the person couldn't private message him.

Could be the man never got your message.

Marc replied tonight saying he will send $35 dollars for repairs and not a cent more and that the condition of the cue is still good. I accepted the $35 and I will repair the cue with it. Of course put money on my end. Bottom line is that I will never send a payment as a gift again and definitely finished doing business with Marc. Thank you everyone for your support and opinions I will update you if he stands by his word.

What did you pay for the cue, was it 250.00?
This Marc guy puts his character on the line for a inexpensive cue. He could of refunded the 250.00 and this thread never would of made it to the boards..
Desperate people do desperate things at desperate times..
Beware when approaching Marc in any transaction..

I'm of the opinion that no sale is complete unless both parties are satisfied. His pics clearly didn't show the issues the cue had and there was no mention of the warped shaft. 35 bucks and an ultimatum is just bad customer service. I'd be pissed too.

Go to any cue builders shop that knows what he's doing, and has good equipment...

What kind of repair do you get in a qualified shop for 35.00?

A new tip..

What is PayPal going to other than suspend your account for paying for goods as a gift. Their rule, your violation.

I agree. 35 bucks is nothing.

OP says he learned a lesson...don't gift anybody unless you aren't willing to lose the money to. Paypal funded by a credit card, only way to go.
