one pocket shot question

Say i have a ball at the jaws of the pocket, and CB is behind and froze to OB close to the pocket ( i need few balls to win)
My opponent shoots the CB such that he miss cue from top of CB (maybe on purpose) and his cue hits my OB and pockets it, CB remain on table with no shot for me. So he knows it is a foul and spots a ball.
The question is, do i have rights to put my OB back at jaws of the pocket, or he is smart player.

I play 1 pocket most of the time and I have never had that happen. I am assuming that you want your ball back up in the pocket so you can have a shot and a chance to make more. I really think that you ball stays down.--Smitty
 
Is it the cue that makes the ball? If the tip makes the ball, not the cueball or any ball for that matter, the ball would respot where it originally lay.
 
This is a good question. If he commits a foul I would think you cannot restore your ball. That is the general rule regarding disturbed balls when playing cue ball fouls only.

On the other hand, was a foul really committed (assuming cue ball fouls only)? I'm not sure about that, but perhaps there wasn't a foul i.e. if he didn't touch another ball or any ball, including the cue ball, went through the area originally occupied by the moved ball. If there wasn't a foul then you should be given the option of restoring the ball to its original position.
 
What results from the cueball after the action of the cue hitting the cueball is legal. If the cue hits your object ball and makes it, you can place the ball where it lied previously. Same thing as if you accidentally move a ball with your hand...the opponent can leave it where it lies or replace it.

Just like if someone leaves you hooked and the nine is in the pocket you can't use the cue to shoot the nine in directly. In 9 ball, the 9 would be replaced and the opponent would have the table

In one pocket, the ball woule be replaced and you would shoot from where the cueball lies.

There are several printed rules for One Pocket: The BCA rule book, The OnePocket.org web site, The Derby City Classic rule, and various house rules and interpretations. I generally like the OnePocket.org rules. Gambling and tournament rules vary as an example: the 3 foul rule in used in many tournaments but no so much when gambling.

Here is the OnePocket.org rule covering your situation.

6.6 Intentional fouls are an accepted part of One Pocket tactics as long as they are played by use of a legal stroke, such as by lightly touching the cue ball with the cue tip; by rolling the cue ball to a new location without regard for legal contact with either an object ball or a cushion; by pocket scratching the cue ball; or by using a legal jump technique to force the cue ball off the table. However, if the acting official rules that a player has used an illegal technique to direct the cue ball or any object balls to a more desirable location, then the incoming player has the option of either playing the balls where they lie, or requesting the official to restore all such moved balls to their location prior to the illegal maneuver. The offending player is charged the standard one ball foul penalty, and in addition may be further penalized at the discretion of the acting official under the general rules of unsportsmanlike conduct
 
All the balls are replaced.It is still your opponents shot untill he contacts the CB.

If he played the shot by nicking the CB with his tip and pushing the OB into you pocket with the tip then it is a deliberate foul.Even an intentional foul must be perforemed with a leagal forward stroke or you will have the option of replacing the ball(s).
