Hi everyone,

I have a request..and yes, it could possibly be a dangerous one. My website is in the works and I am in desperate need of pictures to put up. If you have any...good, bad, whatever could you please post them.

I hope you are not just kidnapping pictures from the web, to put on your web site. Whether you know it or not, using pictures, without the proper permission, is illegal and you could be opening yourself to legal action.
Just because a picture is on the web, doesn't mean that it is free for everyone to use.

Ummm...I think she's referring to pics of herself for her site. If they are pics of her why the hell should she need to get permission....did the photographer get a model release from her? Who actually has rights here the photog taking pics at a public event or the subject of the pics?

If you like I could come over to Mark's and take some pics. I'm not a great photographer, but I'd be glad to help in any way possible.

Sarah is referring to pictures of herself, for her site, taken by the owners.. Many people here have been to events and taken photos of Sarah. That's what she's asking for.

She's not a kidnapper! And her webmaster knows the rules of photo sharing on the web is..which...if you aren't sure...

Hers is the actual wording of the FAIR USE clause:

§ 107. Limitations on exclusive rights: Fair use38
Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include —

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.

The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

*Actually you would be surprised what isn't covered so you better be sure before, you claim "FAIR USE". You will usually get a nice letter from an attorney asking you to stop well before the lawsuit actually starts.

That being said I hope lots of people give her permission to use their photos, and best of luck on the site.

Actually, both have rights.

If Sarah is the only one in the picture, and she is using it, obviously, she wouldn't need to sign a release for herself. However, if someone else is in the picture, a release from that person, or persons, should be obtained.

The photographer does automatically own the copyright on the picture, until he grants use to someone else.

I just didn't want Sarah to go searching the web, for pictures of herself, assuming she could use them on her web site. That would be a mistake.

Obtaining the proper permissions is all that I am suggesting.

Consider this possibility.
Because of Sarah's general appeal, it would not be impossible for someone, trying to help out, to search the web to find pictures of Sarah and post them here. Assuming they were posted by the original photographer, Sarah would then use them on her web site. This could lead to trouble, because Sarah would not have permission from the photographer.
This is not an impossible situation. Most people don't have a clue about the laws that govern the use of photographs and "it is better to be safe than sorry."

If you as a photographer take pictures of me, you can not use them for anything other than private use, unless I authorize it as well.

You are correct, for the most part.
If you were involved in a newsworthy event, like a pool tournament, I could use your photo in a report about that event.
However, I could not use your photo on my web site, to promote my photography without your signed release.

In either case, as the photographer, I would own the copyright for the photo, so you also wouldn't be able to use it without my permission.

Thos pictures wouldn't be from the Viejas Casino in Alpine, CA this year would they?
 
No, These were taken at the National 9 ball Championships last year in Lincoln City, OR.

I completely understand what you are saying... I am very aware of this, working in the design and art field for many years, and will indeed obtain all needed permissions and give credits when/if needed. :)

Hey Rich, I spent the last 12 hours putting together a list of websites that have kidnapped pictures. I currently have 142,683 on my list. Do you know a good internet attorney I could contact so I can file a class action suit?

I don't know one, but attorneys are not hard to find. There are too many of them around. :D
 
Sarah,

I think I have a couple of pics. of you with Alice Rim.

I will need a release signed by both Alice and yourself, notarized by notaries in at least 3 States. Once these requirements have been met (and I can remember where in the heck they are :o ) you are more than welcome to them. Free of charge! You will have my permission to use them in anyway you see fit, without the threat of lawsuit on my behalf. :p
