pics of pool players

Yokita.

I appreciate you taking them down. Again, I think there would not have been an issue if you had just mentioned on the site the proper photo credit for the images. There is a serious issue with copyright infringement worldwide. I appreciate your understanding. Sharing is not an issue, not giving proper credit and frankly placing them on a site that has a shopping cart was what upset me as I hope you would understand. Thank you again.

Holly

by the way Henho...on legitimate stock photo sites, the photographers are typically paid for the rights to use the images as stock. Images on myspace, if not the photos of the person who has the site or being used for editorial purposes IS copyright infringement. I think it's interesting you would call someone a tightwad when they are just trying to protect their work from being exploited. So...when was the last time someone took something of yours or credit for something you did and you thought is was perfectly ok?

They were not stock images, so I don't really see the comparison.

There are also a number of photo gallery options available out there that allow you to post a gallery on your SITE without using a site that allows the photos to be sold.

The photographers that cover this game that we love can spend an entire week at an event with the hopes of maybe selling 4-5 pics to a magazine. The payment for those pics won't even cover the room they slept in for the duration of the event. But we are all tightwads because we don't want to see those photographers taken advantage of?

Wow what a bunch of tightwads. He is not selling the photos, photoshare has an option to order prints through their sight. And please don't act surprised to see a collection of internet images on someone's sight. Take a look at myspace or other photoshare sights to see plenty of stock images without any disclaimers.

Obviously, you didn't know what you were doing. I didn't get to see the photos, so I don't know if any of mine were included, but I hope not.

For future reference, so you don't get into some real trouble, the law states that any reproduction or use of a photograph, without the permission of the photographer, is strictly prohibited and it is a violation of the copywrite laws.

You can be sued for a violation and ignorance of the law is not a defense.

How about some links to some of these billiards photographers sites. Maybe a pm to Yokita and a friendly post here would create some business for the offended photograper (Holly) and clear up some copyright issues.Clearly many people would be willing to purchase copies if they knew where to get them. ;)

Hi,

I can see why anyone would be upset to see his/her pictures being posted without any credit.

From what I have seen, these phtographers spend thousands of dollars on equipment, along with tones of time, energy, travelling and lodging expenses to provide us with pictures that we can enjoy. Most of them do not really make any decent amount of money for their efforts. On top of that, they(the ones I have met) are usually very nice in letting others share their pictures for free, as long as credit is given and that it is not used for commercial purposes.

I am sorry to see what has happened here, and I highly command Yokita for taking the pictures off.

I cannot speak for Yokita, but from my own personal experience, it is not a common practise to credit a picture in some Asian countries. I remember letting someone share a picture of mine, and it was posted on an official Asian billiard website, with no credit to me at all. It is just that the person really was not awared for the need to do so. This person was my friend, and I know he just simply was unaware.

I also like to take pictures at tournaments, but I am only doing it for fun and there is no way my pictures could be compared to those from professionals. I am so amazed at how they could do certain things that I just could not figure out how to no matter what I try.

When I post a link to my picture gallery, I do not sell the pictures(I am sure they are not nice enough that anyone would want to buy them anyway.:) ) but it gives me great joy if a lot of people would come and check them out. I hope one day my pictures would be close to the standards of those taken by Holly, Diana, JR, Rich R, and all the others. It is a new hobby of mine and is something I really would like to share with everyone. :)

Just my 2 cents.:)

That doesn't make it legal.

Millions of cars are stolen every day, too. How would you feel if yours was taken?

I don't park my car on the freeway with the keys in it begging for it to be stolen - same difference as posting pics on the internet web sites - unless you enable a feature that prevents people from copying pics, EXPECT them to be copied and saved by others.

OR you can put a watermark on your pics so people will know they are from a certain person...

watermark: an personalized icon placed on a digital image similiar to a copyright....

But you do park your car on public streets and in public garages. A professional thief, who wants your locked car, can take it in about thirty seconds. It's funny how you can make a distinction between stealing your car and someone stealing photos off of the internet.

The fact that people choose to share their photos on the internet, does not give others permission to steal them for their own use. Yes, I used the word "steal", because under the law, that is what it is. When you park your car on the street, others can look and appreciate your car, but it doesn't give them the right to steal it.

I believe that it is important for people to share their photos on the internet, for the enjoyment of others, however, those others have to respect the rights of the photographer.

I do have a question for Holly...and any other photographer that replied to this thread....when a photographer spends days at an event with the hopes of selling their pictures to magazines..do you guys get permission for every picture you take, or do you only have to get permission from the pool player for the picture you think your going to sell..I am not quite sure if i understand the concept of owning rights to a picture that are taken possibly without permission of the person in the picture....any clarification on this would be greatly appreciated.

According to the law, if you are reporting a newsworthy event, such as a pool tournament, you don't need permission from the players to use their pictures in a magazine or newspaper. The same portion of the law covers the paparazzi, photographing celebrities, as well as news and sports photgraphers.

On the other hand, if a photographer wanted to sell photos of players, to individual buyers, the photographer would need a release from the player and the player would be entitled to compensation.

This is the "Reader's Digest" version of the law, but I hope it helps a little bit.
