Your ignorance of intellectual property law is obvious by your question. One does not have to register a name with the "trade commission" to have rights to a name and intellectual property rights therein. If you want legal advice, please consult an attorney.

I just got off the phone with mike and we discussed it! so just to let people know!Mike sells outstanding cues and he does not want to hassel with a site right now. we had bought the site from 45.com along with 18 other cue related names that will move us up the search list! the quality cues domain was for sale for 2500.00 from 45.com and we made a package deal and got it for 1500.00 along with getting the other names at a discount, customcues was 7500.00 .mike was well aware of us buying the name befor we purchased it, and he knows if he wants it (now or later) later we will make a deal on it!he knows what we paid for it and bought it as a package deal .it can be his if he ever wants to start a site. happy thanks and enjoy ( but Quality Cues is what mike goes by and that is him) so please do not confuse it the site is not published and is still in building stages. best of luck

Dang, Bill....you didn't have to spend 10 grand to get yourself up toward the top in search engines....all it would take is inserting some meta tags.

domain names and business names

To be the sole owner of a domain name you have to buy it with all the extensions. With the new extensions available now that is a lot of domains to just cover one name such as "qualitycues". As for business names I'm not a lawyer and I didn't even stay at a Holiday Inn Express last night but every good sized town or city I go to has businesses with the same names as those in other towns and cities and I am not talking about chains.

When I went to incorporate I was told I couldn't incorporate as Apple regardless of how I spelled it. However I could incorporate as dba Apple and spell it any way I pleased. Big companies get silly about protecting their name sometimes but they find themselves looking silly when they do it. Sony attacked a cafe because the owner was nicknamed Sony and called it Sony's! How may people would really have thought that Sony Electronics had opened a hole in the wall cafe?

Good post. I looked up qualitycues.com and it appears to have been squatted by someone who knows a little bit. It says it was registered by domainsbyproxy.com, this is a masking company that will allow you to register a domain name and not have your name show in the register info. So if one was so inclined to tool his competition one could register the name, then offer it for sale to that person or company anonymously. Pretty nifty, underhanded, tactics if you wanted to go that route. Not that I would suspect anyone I know of to do that.

The closest we have come to a situation like this is another "dealer" had us in his "tags" and when I saw it, well the phone call wasn't so nice. I don't need to stoop that low and when someone else does, well it irks the crap out of me.
