Did they agree to not play the three-foul rule before the match?
No, I don't think so. In the stalemated game, they were making legal shots.
Shane three-fouled in game 25, but Earl kept shooting. Earl missed the 9 and Shane won the game.

So, if they are playing three fouls, did Earl just miss that call entirely?
The announcers said nothing about it either.
It clearly cost Earl a game if they are playing three fouls.
I'm guessing it was an oversight. Earl played two safeties and made 3 balls in the middle of Shane's fouls, so they may just have forgotten that Shane was on two before the scratch.
