"Warning" Doing business with Scott Erwin

It pains me to have to be posting this but I feel obligated to warn my fellow Az members about dealing with Scott Erwin, son of the legendary Mike Erwin of Muecci cues who passed away last year. I had dealt with Mike many times in the past & after his passing dealt with Scott with no negative issues whatsoever but that has all changed with my most recent experience with him & I have learned that I'm not the only one Az member tbayplayer has had problems with Scott as well, here is the link to his post http://forums.azbilliards.com/showthread.php?t=402486&highlight=Scott+Erwin So about 6 months ago I sent a very expensive John Davis blank to Scott for him to finish for me including 2 new shafts along with a Jensen cue belonging to a friend of mine for repair & refinishing which my friend received back from Scott with no issues fortunately, I would've felt responsible if he wouldn't have got his cue back since I recommended Scott to him & many other people I know in the past. I put no kind of time pressure on Scott as I know most cue makers don't really like finishing someone else's blank, so I had no contact with him for about 4 months & up until this time I wasn't sure about all the particulars of how I wanted it done, joint, rings, etc. when I did call him several months ago I had a fairly clear picture of how I wanted it finished & we discussed this several times & I sent him $400 good faith money via PayPal gifted. After about 3 weeks or so without speaking to Scott I tried to call him to finalize what I wanted well he didn't answer so I left a message asking him to call when it was convenient for him I didn't hear back from him for quite a few days & really thought nothing of it, he's busy, he forgot, whatever! So after about a week I tried again & got the same results & this is how it has remained ever since which at this point is well over a month I even tried emailing several times & he just refuses to have any contact with me which just absolutely confounds me because he's always been dependable & I felt like we were friends I'd had many enjoyable conversations with him over the phone. I just do not understand what's going on with him or why he would do this? If anyone out there reading this knows Scott fairly well maybe they could mention reading this post talk some sense into him I don't intend on laying down for getting ripped off at the tune of 1k & he's on his way to ruining his reputation permanently which would be a shame to see a long family tradition end that way. Thank you to all that have taken the time to read this & once again I caution you about dealing with Scott until he makes things right with me & others that he has hanging out to dry!

That's great input you find it humorous that I gifted Scott $ after years of dealing with him & never having a problem you tend to build trust in someone. I'd find it hard to believe that you have never sent or received funds from on deals with members that have proven positive iTrader track records!

I will only send him Meucci cues. All my other cues go to someone else.

My advice to you is if you continue to call and bug Scott he will just send you back less then satisfactory work, sloppy get it done work.

I would pull your cue from him and sent it elsewhere. That's how this all started for me, he stopped responding. He refunded me and I moved on and sent the cue out to a real professional, who actually gives a shit about you and your property.

Thanks for your input & yes in my messages to him I have demanded he send back my property & refund my $ I have lost all faith in Scott & just want back what is mine.
 
Even if he had sent it regular Paypal, I don't think there is any recourse for something months after the fact.

He knew there was an issue 3 weeks after the fact...

But first show the following to the State Police.....taken from Paypal terms

"Gift - Select this payment type when you’re sending money as a gift for a birthday or other special occasion."

This issue seems to be so common in threads..

Gifted pay pal

Pay pal gifted = paying more taxes on the money sent.
Pay pal gifted when you actually are making a transaction = breaking a contract you have with pay pal and its sending and using a service that part of it was designed where you can send money to someone with out having to pay a fee like western union...................

Pay pal gifted when its really a trans action and getting burned = making a fool out of yourself. You cant even go small claims court.

The only thing legally you could do if you is to show up at his home with the cops and ask him to give you back your cues .
If you conducted any of your business using e mails then that might be enough to go to small claims court..

I hope you get his worked out..........................................................

ripping off paypal is not a good idea-ever.
 
Unfortunate. Some thoughts I had in case you want to sue him.

1. Was your friend with you when you packed and sent both items? Also, do you have a shipping receipt? The receipt alone doesn't prove what was sent however.
So you would want the shipping receipt, and some means of confirming what was sent.

2. So, can your friend confirm the contents of the packaging and shipping in order to corroborate exactly what was shipped.

3. Can you contact who worked on the blank prior in order to get a statement from him as to it's value. You will need something to prove the worth of what was shipped beyond your word.

4. Once you get something proving its value, can your friend confirm that in fact this was the same blank you sent out with his cue.

In all cases of these confirmations, minimally a notarized statement should be obtained and if you file a claim, your friend should go along to testify as well.

5. Any documented records of attempts to contact, ie cell phone logs? Bring the cell phone to court if so rather than printing out the log. Its better evidence because it's pretty tough inserting dated conversations into a cell phone. Much easier to doctor up a printed list, and the court would be aware of that.

I personally don't think this would (initially anyway) rise to the level of a criminal act. It may however, with the additional confirmations, if you can get them, be something you might get a civil judgement on.

Sometimes a letter from a lawyer notifying the party of the intent to take legal action is enough to put a fire under his ass even if you don't retain a lawyer for your small claim action ultimately.
 
dont confuse dishonesty and bad business practices. so far he hasnt screwed anybody.

he is like a lot of self employed craftsmen. they have good intentions but bad results with actually doing the work. then dont want to face the customer.

so the easiest thing is to take your business elsewhere.

and anyone else that follows in your footsteps and gets the same results, well you know what they call that.
