Probably a salesman, and not a very good one.

Any salesman worth his weight knows to stop selling once you get the sale.

To be fair, let's say Jbbilards1, sent a warped cue on purpose. He is a trusted seller but sometimes people want to buy or sell warped cues.

Perhaps the OP thought this was going on. He sends back this worthless warped cue and never gets his money back while Jbbilliards1 continues to do same scam with other people.

If indeed the cue is warped, why does Jbbilliards want it back? It's warped.

There are sellers that do go around selling warped cues. Yes, they deliver and send the cues out but they are sending out bad cues. This should be on iTrader...there should be reviews on whether the product met the description.

Who knows how how many times this cue was around the way.

I disagree. If the seller handed the cue to the buyer instead of shipped it, then we wouldn't be having this discusion at all. Since there was a third party involved, the delivery company, there is no telling what conditions this cue endured to reach the buyer. No reason to tarnish someones I-trader for no good reason. In fact I think you can be banned for frivilous I-trader.

If we are gonna try this thing lets get out the facts.

What was the climate on both ends? Recently or when?
Was it on a plane?
How was it packaged?
What shipping service?

JJ already said ship it back and you get a refund, seems fair to me. If you want to pursue shipping, then I would go after the shipping company. Hire a good lawyer, take it all the way to the Supreme court if you have to!! It's not about the 7 or 8 dollars shipping, It's the principle, DAMMIT!!

I guess I'm different than every body else but if I bought a cue I would just send the shaft back , not the whole cue, and ask for a replacement that was straight. No money would be involved.

The Uniform Commercial Code provisions state:

Section 8.2-719. Contractual modification or limitation of remedy.

4. Buyer shall make a careful inspection at the time of delivery. Buyer’s failure to give written notice specifying any claim within ten (10) days of delivery shall constitute an unqualified acceptance of the labor and material delivered and a waiver of all claims. Seller will not be liable for any damage, warranty or remedy and back charges will not be accepted without prior notification, an opportunity to view and repair, replace or otherwise cure, and approval by Seller. No returned product will be accepted without prior approval.

Most UCC is based on Common Law. The OP might have someone read this to him and explain.I doubt that he can read it himself.

What a great idea ! Sounds like common sense to me.

Question to all sellers: What should have been used to package the CUE Correctly?
After all it is possible the CUE was straight when the seller shipped it right?

Not true. I sold a 314 shaft that I didnt' need and I rolled it when I got it and it was perfect. When I sold it about 3 months later I didn't bother to check it because it was perfect when I got it and it only sat in a case in my safe. The guy got the shaft and said it was warped really bad. I didn't believe him, but told him to send it back to me. Sure enough the shaft was warped. I refunded him the money for the shaft AND his shiping costs.

So, mistakes do happen, that's just life.

I offered this Gary dude double his money back if JB didn't refund him, but he prefers to just stay on here and b.iatch and complain.

2 MONTHS AGO .....I sold a NEW KD LD shaft to someone in florida I believe, the buyer said it was warped beyond playability, I said ship it back no problems, ill refund you. END OF STORY Buyer feels comfort to do business, Seller loses $125 shaft.... the price for business.

I have no problems with that what so ever, BECAUSE that Guy will BUY from me again....

If 2K7 keeps the cue and JB refunds the money, there is still no way to guaranty it will be out of circulation unless we see a video of the cue going up in flames.
I recommend an escrow service to insure that the cue is properly returned, with a full refund to the OP less shipping, escrow fee's, and a restocking charge.
If the restocking charge cannot be agreed to between the buyer & seller, the escrow service manager will mediate the percentage.

This deal is a Mexican standoff at this point.
The only way to settle it is with third party participation.

Within the first couple of posts Russ (poolhustler), a member for 5 years with 138 iTrader comments and purchaser of multiple high end cues, offered the OP double his money if he didn't receive a refund. After getting a guarantee like that, the thread continued for another 80 posts.

The OP has still said he is not sending it back, and the video and pictures he has presented have yet to show any definitive markings that it was in fact the cue in question. Without any evidence, I would have to assume this person is trying to steal a measly $75.

He set out to question jbbilliards rep and has actually damaged his own standing on the forum. At this point, I wouldn't buy from or sell anything to Gary. So many people have told him the way the world works that at this point I can find no other conclusion.

In other words, poolhustler's offer of double your money back if JB doesn't come though was rejected because of a sinister extortion plot.
I wouldn't of played it that way but it makes sense.
For instance, I would of pursued the different shaft method, but this is far more interesting.
I can't wait for the outcome.

If he does NOT send your money back, leave THAT detail in iTrader, and then post your story here.

Wat you guys are mistaking is i have no problem with jb. I understand wat will be easiest is to send it back. However my paypal hasnt been verified and thats the only way he'll send the money which i understand. Jb has been trying to work it out. I just wondered if he sent it knowingly which i now think and understand everyone aint out to screw me over. I am sorry and trying to work out where i send him the shaft to confirm wat i stated and come to an agreement where i keep the butt to make a new break stick outta it.

Right now im on my way to vegas for my sisters wedding so wat we decide will be done monday.
 
Man, PayPal must be super busy these days. I remember a few years ago when they would make the small deposits in your account within a day or two, then you entered the amounts on the site and BAM... verified!

Here's how it reads to me. You started a thread here to slaughter a guy. Virtually every sane member who has come on here has taken his side over you. You are now trying to be nice.

I take my hat off to the seller still dealing with you at all.
