APA in Fulton NY A MUST READ STORY

That sucks for you and your team.

If a guy punched you and others threatened you and your team then they should be forfeited or disqualified (it is actually written in the Team manual) and there should be no grey area about it.

Follow through with the National Office becuause it appears that your L.O. broke the rules by not forfeiting them when it happened.

Here is the rule right from the team manual.

IMMEDIATE ACTION - If hostile physical contact occurs, THE
MATCH IS OVER! There are only two possibilities to consider: only one
team was guilty of hostile physical contact or both teams were guilty of hostile
physical contact. LEAGUE MANAGEMENT MUST EXERCISE ONE
OF THE FOLLOWING TWO OPTIONS:
a. Only one side was involved. In this case, the offending team loses all
points if it is a regular night of play on the weekly schedule, or loses the
team match if it is a Session Playoff or any kind of a tournament match.
The nonoffending team receives five points (75 points in 9-Ball) in the
case of a regular night of play, or advances to the next level in the event
of Session Playoffs or some sort of tournament play.
b. Both teams were guilty of hostile physical contact. In this case neither
team would receive any points for the night in the case of a regular night
of play on the weekly schedule, or if it is a Session Playoff or tournament
play, both teams lose the match, which is the same as saying both teams
are disqualified.
League Management has no alternative other than to enforce one of the above two
options. When considering the above options, League Management cannot
consider who started it, nor can League Management consider that the retaliation, if
it occurred, was justified. The only way both teams can avoid the same penalty is
for one of the teams to refuse to retaliate no matter what provocation they may have
to endure.

Thanks bro, this is the type of ammunition I was looking for. I've been busy at work and haven't had the time to go looking up their bylaws. I assumed things being what they are thay had a "physical violence zero-tolerance bylaw". What would we ever do without lawyers.

Yes I stood there and took his best punch, only because I have 4 dependents and a day job that frowns on my incarseration.

"Safe, friendly, and fun" environment alright...was the Operator even there to make sure people were taken care of or to officiate on any possible misunderstandings or to warn people about their disruptive actions?

He was there in the beginning, but left after an hour or so. He shouldn't have to be there to babysit these maniacs. It seems that the above "zero-tolerance rule" will set things right in the end. That will be the basis of our protest if he says that we need to play again.

OVERRULED, local bylaws. :D

No problem. PM me and let me know how it goes.

If you do win as I suspect you will and you end up in Vegas PM me so we can get together and shoot some while we are down there.

would also be curious to know if the player who assaulted you will be elegible for any replay of your match. an APA suspension should be immediate so therefore the player would be inelegible for the rematch.

Not needed. If anybody on the team is physically violent, the team loses period.

I emailed a copy of the APA policy to the league operator. Haven't heard back from him, but he has no latitude in this decision, they lose.

My 2 phone messages and hand delivered message to the APA manager's inbox have not be responded to so for now APA gets a big :( from me. They clearly know what I want to discuss and have me on ignore. So it seems they are happy just to collect member dues and let the league operators do what they like.

Of course none of this BS will matter when my team and I are at the Masters tournament. For those that are attending I will say good luck and look out for us. I'll be the guy with the lump on the side of his head!

I would definitely not play them again!
The bylaws are on your side 100% & if the LO doesn't
Agree I would call headquarters in St.Louis.
And ass far as the ASSHOLE that hit you, he should be suspended from the APA for LIFE!!!(that's no bullshit either)
In the team official team manual I have on pg. 79 & 80 it says
"To any person who starts a fight or brawl--permanent termination of league and APA membership."

His suspension isn't a priority to me really. He cost himself a trip to Vegas that he had won for his regular team play. That and his life are punishment enough. Fat, drunk and stupid is no way to go through life.

I just learned there is an affiliation between the LO and one of the offending team's members who helps manage the northern part of his territory. Does anybody have any moral conviction anymore? Just do the right things and karma rewards you. These idioits always lose in the end.

Page 80 of the manual is as follows:

It is important that those ladies and gentlemen who cannot act like ladies
and gentlemen adjust their demeanor appropriately or they will be removed
from the League.
League Management must take action against any members involved
in physical contact violations, no matter how remotely League related
they are. It is not acceptable for a couple of members to take their fight
outside, or to agree to meet and fight it out at a later date. If, indeed,
they do fight at a later date and League Management determines it was
as a result of League play, then League Management must take action.
This action would be in the form of follow-up action. A fight that occurs
outside, but during League time, will be considered to be the same as one
that occurred inside. If a player threatens to wait outside until the match is
over, League Management should rule that the entire team match is
forfeited. How can a player and his teammates possibly concentrate on
finishing a match if they feel they will be facing a brawl later on? In other
words, a threat could be treated as physical contact in terms of immediate
action. There is certainly room for a lot of judgment in this area.
Follow-up action by League Management results in penalties such as probation,
suspension and permanent termination of League and APA membership. The
latitude of these penalties is left mainly up to League Management, but the
following guidelines should be observed:
a. To any person who starts a fight or brawl—permanent termination
of League and APA membership.

You broke sever of my pool commandments.

Never gamble with a drunk. Never gamble after midnight in a bar. Always have someone watching your back or in this case your front. Always Keep your back to the wall with a full bottle of beer.

What happened is considered aggravated assault. The cop was right. In cases like these you both go for a ride.

The part I think is funny is he hit you with a cheap shot, his best, and it bounced of like it hit Superman's Cape.

Just saying.

More like Clint Eastwood in Dirty Harry. "Do you feel lucky punk?"

Absent that, we will still win the rematch and I will make the APA follow up on his mistaken decision to award his friends a rematch.

Sorry to hear about the trouble. It's too bad that sportsmanship is out the window. I'm just curious how this team ended up the #1 seed?

They had 210 games total and we had 206 over a 14 week season, 98 of which were mine (7 games x 14 weeks). The third player on our team lost several matches by wide margins and our second string player lost quite a few as well. I was what you would call the ringer, non local talent, from the next county over. Them boys up north don't take too kindly to outsiders.

In my last season, we were playing another team, and my teammate was playing one of thiers (I'll call him "Dick") in our 8 ball league. It's call shot, ball and pocket.

Now, all night, Dick's been playing shots that have been questionable. Clean hits, moving object balls, etc. Heh, in one game, he 'banked' a ball, looked around, and continued shooting.

In this particular game, "Dick" had two balls near the pocket, and his cueball position allowed him to shoot either one.
So my teammate politely says, "Hey Dick, just let me know which one you're playing, ok ?"
Dick turns around and says, "What ?!?!?!"
"I just wanna know which one you're playin."
"I know which one I'm playing !!!!! 5 BALL !!!!!!", and drills it in the pocket.

Game is over (my buddy ends up winning), and goes over to shake Dick's hand. Dick grabs his hand and says, "Don't ever f***in' question me, f***er !!!!!"
"Hey, I just wanted to know which......."
"Don't ever f***in question me.....GOT IT ???"
"Wow. Didn't mean to make you angry, Dick. You don't have to be an a**hole about it."
"What'd you call me ????"
"I just said, you don't have to be an a**hole."

Luckily, myself, another teammate, and the opposing captain were watching this take place, and recognized the potential for what could have happened when "Dick" started to break down his cue and hold the forearm in a threatening manner. And the three of us were between the two of them before it got any farther.
After a bunch of obscenities from "Dick', things managed to calm down to the point where we could resume play. For the rest of the night, and between the constant dirty looks from "Dick" (which reminded me of that bull in the Bugs Bunny cartoons), I continued to reassure my buddy not to worry about it.

Match is over, and everybody goes to shake hands. My buddy holds his hand out to Dick, and starts to say, "Hey, man. I think things just got a little out of hand........."
"WAIT UNTIL YOU COME TO OUR BAR, F***ER. YOU'LL BE ON MY TURF THEN." and storms out.

My buddy is a bit shaken, so my captain and I continue to try and ease his mind. We all leave together, go to our cars, and go our seperate ways. Nothing happens, everybody gets home safe.
Next week, against a different team, not only do we find out that the same sort of thing happened with "Dick" and a member of THAT team, but my buddy's incident makes FOUR TIMES that Dick has threatened some sort of violence to a league member. And each instance (including my teammate's) has been reported to the LO.

So we begin to question why this has continued to go on.........

The bar that Dick plays out of sponsers 9 of the 34 teams in the league.

So much for the LO doing the right thing..........

Thats un friggin believable Master9.

In Canada he would have automatically got an assault charge. If you went to the Dr. and told him that you have trouble hearing because of the hit and got a Dr. report, it would have been upgraded to assault causing bodily harm.

Karma does work and there are many ways of getting vengeance without fisticuffs. By your posts, you don't strike me as a vengeful person.
Probably just as well.

Just a bunch of good ole boys with connections, right from the LO to the cops. How do you win against that kind of BS?

Does the loser who hit you have a job and some assets? If you I can tell by your posts you are traumatized, probably have blurred vision, vertigo, tinnitis and several physical and mental maladies as a result of the assault.

The hell with winning a pool game, win some cash.

File a law suit and show up with the cops and get them arrested that night. They will forfeit, you go to court to win money. WIN, WIN, WIN! :)

Lawsuit smawsuit you think too smal

Lawsuit smawsuit you think too smal!!

My lawyer and I are considering a class action suit involving all the players injured by drunk opponents in APA sanctioned events. We expect over 1,000 parties to file under the plantiffs cause. Please respond with you list of damages if contacted thank you.

Come to think of it my neck does hurt and all I hear is ringing in my ears, like a cash register!!

Thanks guys for getting it and having fun with me, Brian.

LOL the APA will be charging host locations to buy insurance to have their leagues in after this. I don't know for positive but I was told by a guy who use to run an ADA "American Darters Association" owned by the APA and owned the bar it played out of they wanted him to purchase their insurance to allow steel tip darts as it could cause injury. That sounds NuTs.
