Very cool but the patent pending is likely just for show... I have one from the 70s that is almost identical.... However mine is worn out and the picture looks like it's good quality... I'll be buying a new one =D
Thanks for the post
You are correct that I am not a pattent attorney but as an inventor I have done extensive research.... Patent Pending costs nothing as it signals intent to some degree... What do you see that would earn a patent based on the original design that would differentiate itself? There is nothing materially different in purpose or design that is worth the investment or that will not have the patent office kicking it... Patent research is where the costs really lie... I have TALKED to several attorneys over several products at this point and can wager this one will not get a patent.......
Chris
Just make sure your brother isn't charging you by the hour.... Or maybe find another attorney.... If he can't tell you the 5 easiest ways that this could be 99% knocked off without violating patent law if someone owned it... He should have studied harder.... I'll buy one and am not interested in the product as a seller.... OHHH wait magic eight ball and bottle opener... I am in.... See you in court......
No.2 there are design elements of this that are indeed patentable
Obviously I am not an Attorney either but, what would those design elements be?
In Canada anyway, I thought that a particular design had to have a certain percentage of scientific difference to be able to qualify.
Its a Fuggin bottle opener man on top of an 8 Ball. Use a 9 Ball then.
I don't care anyway. If I get a tough twist off, I use a Bic lighter to pop it.
Not a ton of Science behind that design. Looks cool. Can sit on top of your Rec Room Bar.
Anyone with a Milling Machine and an 8 Ball can make that. Shit, a drill press and a file for that matter.
Probably make a better pocket marker than an opener anyhow.
Pretty cool looking.
But everything is a Pop Top or Twist Off these days.
What would it be used for?

You need to do more research...My brother is a patent attorney No1. ....No.2 there are design elements of this that are indeed patentable... Consult your attorney(s) as I have done mine...
