Dennis Orcullo banned from USA for five years

Travel visa laws are simple: they're not designed to be used for what amounts to virtual citizenship. Is the penalty unfair? I don't think so. Dennis is no stranger to travel and the rules/regs that go with it. Anything that happened here he brought on himself.
I think the point was:
laws don't always make sense. Sometimes people, who made the laws just made mistakes, because they were just people. Its the right and duty of people in a democratic society to spot such unfair laws and try to change the legislation.

A law is not correct, right or fair, just because it's happens to be a law.

Fines for making a mistake can be fair or overly harsh. And knowing the situation of Denis lots of people think, the fine is too harsh.

multiple posts in these thread tried to point out, that the (immigration US) laws are not simple. I don't think they are simple with 20 years of school, it's probably much tougher still for a pool pro from Phillipines with no proper school education.

You are obviously entitled to your opinion, that the penalty is fair. I just think that it would make for a better discussion using other arguments, than just "it's fair beacause it's the law".
 
If you support a new one that actually follows the constitution of the United States if America, I'm with you.
Nah, the Constitution has either failed to prevent what government has become or it has outright empowered it. The anti-federalists (the Pennsylvania Minority specifically) called the current situation before ratification, though.

Please. So now its poor lil Dennis didn't get schooled right. He's been coming here for 20yrs. He knows the rules. In fact he's done this before. From my earlier post, only about 1% of visa users abuse/overstay in any yr. Looks like 98-99% are able to use their visa and not dog it. I'd venture a guess that the possible penalty(s) are at least partly responsible for so many using their visa correctly.

It would obviously be better, if he would know the laws and wouldn't get into trouble. But the penalty may be too harsh (at least some people in this forum think so) and your main argument was, the penalty is fair, because it's the law.

I think this argumentation is flawed. Since laws can be flawed. The penalty in Denis' case may or may not be fair. But it's a fact, that laws are made by people and some laws are very flawed. And it's better practice to try to make laws, that make sense and to find penalties, that are fair.

I think it's dangerous to assume, any penalty is fair, just because it's the law and he should have known better.

This guy was a serious danger to our society and nation.

And they are shipping in the “war refugees” from Syria a zillion at a time.

Actually the # of Syrian refugee's that come here is tiny. In 2020-21 less than a thousand came here. Biggest # was in '16, around 13,000. Almost all go to Turkey, Lebanon and a few other Mid-east countries. No one is shipping zillions of Syrians here.

in Germany in 1940's you got shot for stealing. Steal rate dropped dramatically.
Some people would probably still think, that death sentense may be too harsh for stealing an apple if you were dying of hunger. Some people may think, it's only fair.

WTF??? these rules/regs have been around for yrs and apparently damn near everyone can manage to use their visa properly. If less than 1.5% on average per yr overstay/abuse i'd say its working pretty well.

I didn't write the laws/regs but i have ZERO problem with them or their enforcement. These players come here from all over the world to make money. Unless its an event that issues a 1099 they most likely pay nothing in taxes. Pretty gravy set-up if you ask me. You'd think the least they could do is keep their visa straight. Apparently i over-estimated their mental capabilities. Won't happen again.
